The applicant seeks the following development standards variance approval: 3. Docket No. PZ-2020-00213 V UDO Section 2.06 Minimum 10-ft side yard building setback required, Crossing 40-ft over side property line requested. The site is located at 1752 and 1730 E. 106th Street (partially in Miller’s Acres Subdivision). It is zoned S2/Residence and partially located in the Special Flood Hazard Area. Filed by David and Lisa Post, owners. General Info & Analysis: The Petitioner owns a metes and bounds parcel of land, as well as a platted lot of land (in Miller’s Acres 2-lot subdivision). Each parcel is approximately 70-ft wide at the street right of way. The west parcel is 0.5 acres, and the east parcel is 0.91 acres. Some floodplain and topography exist at the northeast corner of the overall site. The Petitioner seeks approval to demolish the existing homes on the sites and construct one home across the shared property line of those two parcels. A minimum 10-ft side yard setback is required for structures in the S1 zoning district. The house will cross approximately 40-ft over the shared property line, so that it is centered on the two parcels of land. The site is surrounded by single family detached homes. While the petitioner considered submitting a Primary Plat Amendment and Replat to combine both parcels of land into one large 1.4-acre parcel, they opted instead to go through the public hearing variance process. The Petitioner addressed all the planning/zoning review comments, and the Planning Dept. supports th is variance request, with the conditions listed below in the Recommendation. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. PZ-2020-00213 V with the following conditions: 1.) Dedication of 106th Street right of way to the City per the Thoroughfare Plan Map, and 2) Construction of the 10-ft wide multiuse path along the two parcels’ 140-ft frontage (or payment for what it could cost to build the path into the City’s Non-Reverting Thoroughfare Fund).
