Dear Mr. Wilkos:
At the virtual meeting held on Monday, January 25, 2021 the Carmel Advisory Board of Zoning Appeals took the
following action regarding the Use Variance (UV) request filed by you for the property located at 110 W. Main
Street, Suite #127, in Sophia Square:
APPROVED with CONDITION: PZ-2020-00222 UV: Rita’s Ice and Custard, Use Variance approval for
Restaurant with Walk Up window.
• Approved with the Condition that the Petitioner will have a crowd control line rope/barrier and
stanchions in place when a line forms on the sidewalk so that pedestrian traffic is not obstructed.
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Use Variance
approval is valid for three (3) years. By that time, either continuous construction of the improvements must be
underway, or a written request for a one-time, six-month extension of the approval must have been received and
approval granted by this Department. The expiration date of the approval is January 25, 2024 (that is the deadline
date when the land use must be fully implemented with all renovations, required site improvements, etc.)
Please include a copy of this letter with any permit application.
