Grantor, as its sole warranty herein, specially warrants to Grantee, and to Grantee's successor and assigns, that Grantor will forever defend title to the Real Estate against those claims, and only those claims, of all persons who shall assert claims affecting the title to the Real Estate, or any part thereof, under, by or through, or based upon the acts of Grantor during Grantor's period of ownership of the Real Estate, but not otherwise, subject to: (i) the lien of ad valorem real estate taxes not yet due and payable; (ii) municipal, zoning, and subdivision laws and ordinances; (iii) rights -of -way of public streets; (iv) matters which would be disclosed by an accurate survey of the Real Estate; and (v) those matters set forth on Exhibit B attached hereto and made a part hereof. The warranty of title by Grantor is a limited warranty. Except for the limited warranty of title made herein and any representations and warranties otherwise made by Grantor in writing prior to the date hereof, Grantor makes no representations or warranties with respect to the Real Estate, including without limitation, its habitability, merchantability, suitability or fitness for a particular use or purpose. The undersigned person executing this Limited Warranty Deed on behalf of the Grantor represents and certifies that he is an authorized signatory of Grantor and has been fully empowered, by proper company actions, to execute and deliver this Limited Warranty Deed; that the Grantor has full capacity to convey the Real Estate described herein; and that all necessary action for the making of such conveyance has been taken and done.
