Dear Mike: My understanding is that the remote procedure guidelines for hearings before the Board of Zoning Appeals do not permit either the petitioner or anyone from the public to present testimony or otherwise speak during the virtual meetings. With respect to the above referenced case, please consider this my request on behalf of my clients Cohen Investments Partnership and Barrett & Stokely to be provided the opportunity to speak in response to any comments the Petitioner or its representative is permitted to make at the upcoming hearing on February 25, 2021. It would seem only fair and within the bounds of due process to permit, to the extent necessary, a temporary suspension of the rules, for this purpose. I would be happy to discuss this with you further, and, of course, present this special request to the BZA members at the hearing. Thank you for your consideration.
