DEPARTMENT REPORT
MONDAY, FEBRUARY 22, 2021
(V) Medina Pool Setback Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2020-00224 V UDO Section 5.02.C.7.a Swimming pools and their decking and
equipment need to be located at least 3-ft from an easement, 3-ft encroachment into Tree
Preservation Easement requested. The site is located at 14385 Arnett Dr. (Lot 75 of The Ridge at The
Legacy Subdivision). It is zoned Legacy PUD/Planned Unit Development Ordinance Z-465-04. Filed by
Joe Woolwine of Indy Landscape Concepts on behalf of Miguel A. Medina De La Cruz, owner.
General Info & Analysis:
The Petitioner seeks approval for a small corner of the concrete decking area of a proposed swimming pool to
encroach 3 feet into a 50-ft wide tree preservation easement (TPE). Beyond that tree preservation area on their
lot is the wooded neighborhood Common Area. Also, the pool decking will be located 3-ft to the side property
line, in parts, rather than 5-ft away from the side property line. Please see the Petitioner’s informational
packet for more detail on the variance request.
There are currently no existing trees within the area of the lot where the pool location is proposed.
The pool pump is proposed to be located between the two houses. The Petitioner provided the design details of
the pool pump and heater, to demonstrate how the noise and vibrations will be reduced and muffled.
The Petitioner addressed all but one of the planning/zoning review comments, and the Planning Dept.
supports this variance request:
1. Though not required, please consider planting one additional shade tree on the property, as part of your
variance request proposal, to help mitigate the additional impervious area added to the site and the minor
encroachment into the TPE Area. (Petitioner, what is the status of this request?)
