ORDINANCE NO. _D-2555-20 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ESTABLISHING FOUR MUNICIPAL RIVERFRONT DEVELOPMENT PROJECT AREAS WITHIN THE CITY OF CARMEL Synopsis: Pursuant to Indiana Code § 7.1-3-20-16.1, this ordinance establishes four Riverfront Development Project Areas within the City of Carmel. WHEREAS, Indiana Code § 7.1-3-20-16.1 (the "Act") authorizes the legislative body of a city or town within the State of Indiana to designate and establish the boundaries of a municipal riverfront development project within its territorial boundaries; and WHEREAS, the Act allows the Indiana Alcohol and Tobacco Commission to issue a three-way, two-way, or one-way permit to sell alcoholic beverages, for on premises consumption only, to an applicant who is the proprietor, as owner or lessee of a restaurant within a municipal riverfront development project funded in part with state and city money, without regard to any permit quotas as required by Indiana Code § 7.1-3-22 all in furtherance of economic development; and WHEREAS, the Carmel Common Council has determined that it is in the best interest of the City of Carmel (the “City”) to designate and establish the boundaries of four municipal riverfront development projects for the purposes of Indiana Code § 7.1-3-20-16(d), in order to encourage private investment within the municipal riverfront development projects and specifically to encourage investment by new restaurant proprietors; and WHEREAS, all four municipal riverfront development projects set forth in Exhibit A, attached hereto and incorporated herein by reference, are located within the territorial boundaries of the City, and are also located within and around an economic development area, a redevelopment project area, an urban renewal area, or a redevelopment area established under IC 36-7-14, IC 36-7-14.5, or IC 36-7- 15.1; and WHEREAS, as required by Indiana Code § 7.1¬3-20-16.1(b)(4), all four municipal riverfront development projects have been funded in part with both State and City funds, which are described in greater detail in Exhibit B, attached hereto and incorporated herein by this reference. NOW, THEREFORE, the Common Council ordains, and states as follows: Section 1. The foregoing Recitals are fully incorporated herein by this reference. Section 2. The areas identified as Municipal Riverfront Development Projects in Exhibit A, are hereby designated as Municipal Riverfront Development Projects pursuant to Indiana Code §§7.1-3-20- 16 and 16.1.
