In accordance with Title 865, Article 1, Chapter 12 of the Indiana Administrative Code ("Rule 12"), the following observations and opinionsare submitted regarding the various uncertainties in the locations of the lines and corners established this survey as a result of uncertainties inreference monumentation; in record descriptions and plats; in lines of occupation; and as introduced by random errors in measurement("Relative Positional Accuracy"). There may be unwritten rights associated with these uncertainties. The client should assume there is anamount of uncertainty along any line equal in magnitude to the discrepancy in the location of the lines of possession from the surveyed lines.There may be differences of deed dimensions versus measured dimensions along the boundary lines shown hereon and, likewise, there maybe found survey markers near, but not precisely at, some boundary corners. In cases where the magnitude of these differences are less thanthe Relative Positional Accuracy stated below and less than the uncertainty identified for the reference monumentation (discussed below), thedifferences may be considered insignificant and are shown only for purposes of mathematical closure. Such differences that are greater thanthe Relative Positional Accuracy and the uncertainty in reference monumentation should be considered worthy of notice and are thereforefurther discussed below.This survey and report are based in part upon opinions formed in accordance with an Indiana Land Surveyor's responsibility to conduct asurvey in accordance with "law or a precedent" (865 IAC 1-12-11(5), Rules of the Indiana State Board of Registration for Land Surveyors).Since Indiana has no statutes addressing how to resolve boundary lines, a solution based on principles derived from common law precedentmust be relied upon as the basis for a boundary resolution.Unless otherwise noted or depicted hereon, there is no evidence of occupation along the perimeter lines of the subject tract. All surveymonuments set or found this survey are flush with existing grade unless otherwise noted.The Relative Positional Accuracy (due to random errors in measurement) of this survey is within the specifications for a Urban Class Survey(0.07 feet plus 50 ppm) as defined in IAC 865.This survey was commissioned by the client to perform a Boundary Retracement Survey of the real estate conveyed to Jeffrey Jay Teeter andJane Ellen Teeter in Instrument Number 9909903888 as recorded in the Office of the Recorder of Hamilton County, Indiana. Said real estate ispart the Northeast Quarter of Section 7, Township 17 North, Range 3 East of the Second Principal Meridian, Clay Township of HamiltonCounty, Indiana.Reference Surveys and Plats1) Boundary Survey by Gary R. Kent of Schneider Engineering Corporation dated May 13, 1991 and recorded as Instrument Number1992027759. This survey was the basis for Ashbrooke Subdivision and includes a comprehensive breakdown of the Northeast Quarterof said Section 7.2) Secondary Plat of Ashbrooke Section 3 as recorded in Plat Cabinet 1, Slide 467 as Instrument Number 9440466.3) Secondary Plat of Ashbrooke Section 4 as recorded in Plat Cabinet 1, Slide 468 as Instrument Number 9440467.4) Replat of Block B Lot 2 at West Carmel Center as recorded in Plat Cabinet 3, Slide 438 as Instrument Number 200400046220.5) Secondary Plat of West Carmel Center Block B Lot 3 & Lot 4 as recorded in Plat Cabinet 3, Slide 162 as Instrument Number 200300041664.6) Location Control Route Survey for 106th Street recorded as Instrument Number 2009017554.7) Hamilton County Surveyor's Office (H.C.S.O.) Section Corner Tie Sheets.Reference Monuments1) Schneider rebars were found at the Northwest corner of Ashbrooke Section 4 and at the Northeast corner of Ashbrooke Section 3.These monuments were set during the aforementioned Kent survey and were held as controlling to establish the north lines of theAshbrooke subdivisions which thereby established the south line of the surveyed parcel.2) No monument was found at the surface for the Northwest corner of the Northeast Quarter of said Section 7. The tie sheet, datedAugust 3, 1976 calls for a railroad spike over a stone. The Kent survey calls for a concrete nail set. This corner was established byextending the west line of Ashbrooke 4 north 689.62 feet per said Kent survey which matches the deed distance of 689.6 feet.The extension of this west line passes through two American Consulting rebars marking the east lines of the aforementioned WestCarmel Center plats. There could be up to 0.2 feet of north-south uncertainty associated with this calculated location.3) A Harrison monument was found marking the Northeast corner of the Northeast Quarter of said Section 7. The tie sheet referencesa railroad spike a this corner up until 2010 when the stone was found and the Harrison monument was set over it. The calculatedlocation of the railroad spike per the Kent survey falls 2.1 feet south of the location of the Harrison monument.4) The Southwest corner of the Northeast Quarter of the Northeast Quarter was calculated per the Kent survey. This is the point ofcommencement for the 56.00 foot wide parcel of the surveyed property.5) The Northwest corner of the Northeast Quarter of the Northeast Quarter was calculated per the Kent survey but was then extendednorth to intersect the north line of the quarter section established between the calculated northwest corner of the quarter section andthe Harrison monument at the northeast corner of the quarter section.Record DescriptionsThe lines and corners of the subject tract were located hereon based on controlling calls contained in the record description or therecord plat for the subject tract. Unless noted otherwise, the boundary lines of the subject tract are contiguous with the boundarylines of all adjoining parcels, adjoining streets, highways, rights-of-ways and easements, public or private along their common boundaries as described in their most recent respective legal descriptions of record.1) Multiple pipe line easements cross the surveyed property as depicted hereon.2) A open legal drain known as Crooked Creek crosses the survey parcel. Per Indiana Code 36-9-27-33, there is a statutory easement of 75 feet measured perpendicular from the top of bank on both sides.3) At the time of this survey, there has been no documentation found or provided for any right-of-way dedication associated with thesurveyed property.4) The description of Subject Parcel 1 calls for the north line to bee 884.3' and the south line to be 894.3', a difference of 10 feet. It alsocalls for the east line to be 684.3' and the west line to be 689.6', a difference of 5 feet. The call for the south line to be parallel with thenorth line makes it unlikely that there is a 5 foot difference between the east and west line.5) The description of Subject Parcel 2 (Also) has several typos and incomplete courses. Evidence of Occupation1) An old farm fence lies generally along the west line of the surveyed property.2) An old farm fence lies between on line and 2.0 feet north of the south line of the surveyed property.3) At the west end of the south line of the surveyed property, there is a wood fence which lies between 2.6 feet south and 4.5 feet southof the line.4) An old farm fence lies generally along the east line of the surveyed property except for the south end of the fence is 0.6 feet west ofthe corner.As a result of the above observations it is in my opinion that the uncertainties in the location of the lines and corners established on thissurvey are as follows:Due to variances in Reference Monuments: Up to 0.2 feetDue to discrepancies in the Record Descriptions: Up to 10 feet based on deed calls.Due to inconsistencies in Lines of Occupation: Up to 2 feet based on fence location.The horizontal data shown on this survey are based upon a positional solution derived from Global Positioning System (GPS) observationsprocessed by National Geodetic Survey (NGS) utilizing their Online Positioning User Service (OPUS) software. The coordinate values shownare in the Indiana State Plane Coordinate System (East Zone) reference to the 1983 North American Datum utilizing the ContinuouslyOperating Reference Stations (CORS) adjustment as determined by NGS (NAD 83 (2011)(EPOCH 2010.0000) with a reported overall rootmean square (RMS) of 0.018 meters.2. Ownership information indicated hereon is as identified in County or Township records or on title work provided by others.3. The subject parcel is zoned S-1 per the Comprehensive Zoning Maps for the City of Carmel, Indiana. The setback requirements for saidzoning can be variable, transitional and subject to legal interpretation, therefore, setback lines are not depicted hereon.4.
