SURVEYOR'S REPORT In accordance with Title 865, Article 1, Rule 12, of the Indiana Administrative Code, establishing minimum standards for the practice of land surveying in Indiana, effective August 16, 1991, the following observations and opinions are submitted regarding the various uncertainties in the location of the lines and corners established on this survey as a result of: a) Availability and condition of reference monuments; b) Clarity or ambiguity of the record description used and of adjoiners' descriptions and the relationship of the lines of the subject tract with adjoiners' lines; c) Occupation or possession lines; d) The relative positional accuracy of the measurements; This is a retracement survey of land owned by multiple owners as shown on the within survey. The property is located in the Southeast Quarter of Section 24, Township 18 North, Range 3 East. A portion of the property is the plat of Kensington Green, recorded in Instrument No. 2017015866 and Lot 4 of Reading Tree Park, recorded as Instrument No. 2010028639. The location of the corners and the lines of the subject real estate is dependent upon the location of the South and West lines of said Southeast Quarter, the East line of the West Half of said Southeast Quarter, the south right of way of U.S. 31, and the east boundary of Lot 4 of Reading Tree Park. The basis of bearings is Indiana State Plane Coordinate System East Zone (NAD83) along the South line of said Southeast Quarter between a brass plug found at the Southwest corner and a Mag spike found at the Southeast corner of said Quarter Section. The South line of said Southeast Quarter was established from a brass plug in concrete (0.4 feet below surface) found at the Southwest corner and a Mag spike (at surface) found at the Southeast corner of said Southeast Quarter. The West line of said Southeast Quarter was established from said brass plug at the Southwest corner and a Harrison monument found at the Northwest corner of said Southeast Quarter. The found monuments agreed with the section corner ties found at the Hamilton County Surveyor's Office. The uncertainty of said monuments is considered to be negligible. The East line of the West Half of said Southeast Quarter was established from holding the midpoint of the South line of said Southeast Quarter and projecting the line Northerly through a 5/8—inch rebar found at the north end of a 4—foot tensile wire fence near the former right of way of the Monon Railroad. Another 5/8—inch rebar was found on the projected line near the southeast corner of land conveyed in Instrument No. 2018060774. The 4—foot tensile wire fence runs along or within one foot of the established East line. No section corner reference ties were found for the corners to establish said East line. The northern boundary of the subject real estate is also the southeastern right of way of U.S. 31. The land for U.S. 31 was conveyed as fee simple title as described in the documents shown on the within survey. It also appears that the fee simple title documents were created based on the Indiana State Highway right of way plans, Project No. ST—F-222(9), 1968. It appears that the fee simple documents described in Cause No. 71-149 and Deed Book 241, pages 164-166 are holding the northern and southern boundaries parallel with Line K as shown on said right of way plans. The southeastern right of way as described in Cause No. C74-112 was established from holding the record distance of 212.73 feet from the southeast corner of Deed Book 241, pages 164-166 and the record distance of 67.70 feet from the northeast corner of land described in Instrument No. 2018049881. The intersection of the two distances is the southeast corner of the said Cause No. C74-112 (also point of beginning). The southwest corner of Cause No. C71-150 was established from holding the record distance of 134.22 along the previously established alignment from the east corner of said Instrument No. 2018049881. The 123.46—foot course was established from holding the alignment of the limited access right of way control line for Cause No. C74-112. The limited access right of way was established from holding a line from the terminating point of the limited access right of way described in said Deed Book 241, pages 164-166 to the southwest corner of Cause No. C74-112. The 388.65 (D.) foot course of the southeast right of way of Cause No. C71-150 was established from connecting a line between the 123.46—foot course and holding the record distance of 68.00 feet along the western right of way of the former Monon Railroad. The east boundary of Reading Tree Park (Instrument No. 2010028639) was established from holding the platted distances and angles and rotating it to the established East line of the West Half of said Southeast Quarter. The subject properties contained within the overall boundary were established from holding the deed distances and angles where possible. There are no major internal deed discrepancies between the subject deeds. Many of the deeds called to adjoining deeds and the distances agreed with the adjoining deeds. There are also no major discrepancies between the overall boundary and the adjoining properties. There was no record right of way documents found for Smokey Row Road except for the portion that was dedicated as part of Kensington Green. A portion of Rohrer Road was also dedicated as part of said Kensington Green. The 16.5—foot right of way shown for a portion of Rohrer Road was called out in Cause No. 71-149. There Is not much evidence of occupation along the overall boundary of the properties. Any occupation evidence Is as shown on the within survey. This survey is classified as an urban survey. The acceptable relative positional accuracy for an urban survey is 0.07 feet + 50 ppm, as defined in 865 I.A.C. 1-12-7. The within plat of survey was prepared based on deeds, plats, and easements from a search performed by this surveyor and from Near North Title Group. Not all the title commitments were provided for the within properties.
