DEPARTMENT REPORT

(V) North End Urban Farm Variances.
The applicant seeks the following additional development standards variance approvals:
4. Docket No. PZ-2021-00056 V UDO Section 2.18 Minimum 2-story height required, 1-
story requested.
5. Docket No. PZ-2021-00057V UDO Section 2.18 Maximum 20-ft rear yard building
setback required, approximately 600-ft requested. The site is located at 270 and 280 W. Smoky Row.
It is zoned UR/Urban Residential. Filed by Rebecca McGuckin of Old Town Companies, LLC.
General Info & Analysis:
The Petitioner seeks variance approval for height and setback for a dwelling that will be used in tandem with
the proposed urban farm land use (which was granted BZA use variance approval last year under Docket No.
19100015 UV for a farm use and for roadside sales land use). Please see the Petitioner’s informational
packet for more detail on the variance requests.
The dwelling structure proposed for this site will be 1-story tall. The minimum allowed building height in the
Urban Residential District is 2 stories. A 1-story house would complement the prior-approved urban farm use,
which is a different intensity and scale than higher density and intensity Urban Residential uses. A future
greenhouse will also become a part of the urban farm and also be located on this approximate 5-acre area.
The rear building setback proposed for this urban farm site is approximately 600-ft. The Urban Residential
district requires a Maximum rear setback of 20-ft. The approximate 5-acre site allows for plenty of room to
place a dwelling structure. Placing the structure close to Smoky Row is preferred, but it moves is further away
from the north/rear property line.
There is some floodplain on the property, and the structures will be kept outside of that area.
The Petitioner addressed all planning/zoning review comments, and the Planning Dept. supports these
variance requests.

Recommendation:
The Dept. of Community Services recommends positive consideration of PZ-2021-00056 to 57 V.
