I can absolutely make revisions to the design in time. However I had discussed the removal of the figures out of our mural design with George Nae. We both have a couple questions for you before sending our follow up proposal. 1. We discussed if the design containing the figures were to be considered a sign, how would we be able to legally file this for a sign permit? Only one sign is allowed for this property because it only has one Street Frontage. The Ground Sign in the front of the property along Range Line Rd. is the one sign. In order to allow another sign a variance will need to be applied for. I gave a brief overview in an email you were copied on (also attached). 2. I understand landscapes are accepted. So my question is, what exactly could be considered acceptable artwork? For example: Abstract shapes, wildlife, inanimate objects, urban landscapes, etc. I know that the city of Carmel has a large-scale mural by the artist “MuckRock” featuring rabbits, vegetables, and typography. All the examples you gave are acceptable. My office refers to the City definition for Sign when determining how to classify work. It reads, “…Any structure, fixture, placard, announcement, declaration, device, demonstration or insignia used for direction, information, identification, or to advertise or promote any business, product, goods, activity, services, or any interest.” When reviewing this particular petition with the Plan Commission legal counsel it was determined that the individuals meet this definition, while the landscape and architecture do not. When a property owner asks for improvements to a site, such as this petition, Staff requires that the site is brought into compliance. They will need to be installed within 50-ft. of the main entrance. Currently the property only has one Street Frontage (S. Range Line Rd.) and may only have one Sign per the Carmel Sign Standards. Currently the Ground Sign in the front of the business is that one Sign allowance. In order to allow the characters in the mural a variance will need to be applied for and then seen by the Board of Zoning Appeals because it is then considered a second sign on the property. The Development Standards Variance application contains all the information regarding the process (please note this does not accurately reflect the fees) and you can find the 2021 calendar here. Unfortunately Staff is unlikely to support such a request at this point in time, which is why I have been guiding you towards the landscaping and architecture imagery only. Having the landscape and architecture then only requires an ADLS Amendment approval from the Carmel Commercial Committee (which is the process we are currently going through).
