CC 04-19-21-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, REGARDING TRANSFER OF REAL PROPERTY TO THIRD PARTY Synopsis: Resolution approves the sale of excess real property located near 96th Street and Keystone Parkway that is not needed for a public purpose and establishes a minimum sales price. WHEREAS, the City of Carmel, Indiana (hereinafter, the “City”) acquired certain property located near the intersection of Keystone Parkway and 96th Street (the “Property”) for the purpose of building a roundabout at the intersection of Keystone Parkway and 96th Street; and WHEREAS, only a portion of the Property is necessary for the right-of-way for the Keystone Parkway and 96th Street roundabout (the “Right-of-Way Area”); and WHEREAS, the Property excluding the Right-of-Way Area (the “Remainder Parcels”) consists of three parcels of real property and are not needed for any other public purpose; and WHEREAS, the legal descriptions of Remainder Parcels A, B and C are set forth on Exhibit A attached hereto; and WHEREAS, the sale of the Remainder Parcels was approved by the City’s Board of Public Works & Safety (“BPW”) on April 7, 2021, as Resolution No. BPW 04-07-21-07. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Carmel, Indiana as follows: 1. The foregoing Recitals are incorporated herein by this reference. 2. The Common Council hereby approves the sale of Remainder Parcels A, B and C, which shall be sold pursuant to I.C. 36-1-11-4. 3. The purchase price for Parcel A of the Remainder Parcels shall not be less than One Hundred Fifteen Thousand Dollars ($115,000.00) adjusted by reasonable and customary closing costs and other expenses incurred by the City as result of such sale. 4. The purchase price for Parcel B of the Remainder Parcels shall not be less than One Million Seven Hundred Fifty Thousand Dollars ($1,750,000.00) adjusted by reasonable and customary closing costs and other expenses incurred by the City as result of such sale. 5. The purchase price for Parcel C of the Remainder Parcels shall not be less than Eight Hundred Fifty Thousand Dollars ($850,000.00) adjusted by reasonable and customary closing costs and other expenses incurred by the City as result of such sale. Crider, Director of the Department of Administration for the City of Carmel, Indiana, as its agent for purposes of completing the disposition of the Remainder Parcels. James R. Crider is hereby authorized to execute all documents required in connection with the disposition of the Remainder Parcels pursuant to this Resolution and to take all other lawful actions necessary to complete the acquisition, offering and disposition of the Remainder P arcels as contemplated herein.
