The applicant seeks a PUD Ordinance Amendment, Rezone, and Primary Plat Amendment approval to add a 0.5-
acre piece of property into the Silvara PUD and combine it with lots 324 and 325 of Section 7 at Jacksons Grant.
The site is located directly south of 523 Cornwall Ct. It is zoned S-1/Residential. Filed by Doug Wagner of
Republic Development on behalf of the future lot owners.
Project Overview:
The purpose of this proposal is to add a 0.5-acre piece of property, known as the Gallagher Parcel, into the
Silvara PUD (Jackson’s Grant Subdivision) to make Lots 324 and 325 bigger. The property is currently zoned
S-1 residential and so it must be rezoned to the Silvara PUD, the Silvara PUD must be amended to include the
new parcel into the legal description and exhibits, and the Primary Plat for Jackson’s Grant must be amended to
show Lots 324 and 325 absorbing this parcel. Please see the petitioner’s information packet for more
details.
The proposed primary plat amendment would add a little more land to lots 324 and 325 in Jackson’s Grant to give
them more buildable area. There is an existing 30 ft. tree preservation easement and then a 30 ft. drainage and
utility easement toward the rear of each lot. This narrows down the area to build a home. The future homeowners
would like to add the Gallagher Parcel to their lots to help with the layout and buildable area of their lots. The
30 ft. Tree Preservation Easement and the drainage and utility easements will remain at the new rear of the lots.
In addition, a 15 ft. landscape easement will be added outside of the 30 ft. tree preservation easement per the
request of the adjacent property owner and seller of the Gallagher Parcel. This will help ensure a nice landscape
buffer is maintained at the rear of the properties.
The Gallagher Parcel is not within an existing subdivision, but it is zoned S-1 and so the proposed rezone and
ordinance amendment will bring the parcel into the Silvara PUD so that the PUD standards will apply to the parcel
and it can be added to Lots 324 and 325. No other changes to the Silvara PUD are being made and no additional
lots are being created. This is simply allowing Lots 324 and 325 to gain a little bit more useable land.
DOCS Remaining Comments/Concerns: The petitioner has addressed all of our comments The City does not
believe this will have a negative impact on the area or neighbors but will benefit the community by creating a
better layout for this section of Jackson’s Grant.
Recommendation:
The Dept. of Community Services recommends the Plan Commission votes to suspend its rules of procedure
and votes to Approve the Primary Plat Amendment and send the Rezone and Ordinance Amendment to the
City Council with a Favorable Recommendation this evening.
