Niemier 1) Section 5.39H2b allows two building wall signs. Three building wall signs are requested. 2) Section 5.19 requires buildings be no more than fifteen feet from the property line. Our building will be thirty feet from the property line along Hopewell Parkway due to an existing thirty foot wide utility easement along Hopewell Parkway. 3) Section 5.28C and the related table require seventy-seven parking spaces. Adjacent properties will not be adversely affected and the proposed restaurant on this property will benefit all businesses in the surrounding area. Strict application of the existing Zoning Ordinance would result in an unnecessary hardship in the use of the subject property due to the width of existing utility easements and the requirement to align our drive lanes with existing drive lanes on the adjoining property reduces the number of available parking spaces on our parcel. LEGAL NOTICE to all adjoining and abutting property owners is also MANDATORY; two methods of notice are recommended: 1) FIRST CLASS MAIL with CERTIFICATE OF MAILING sent to adjoining property owners.
