Re: BZA Docket No. PZ-2021-00059 V: Garlin Sunroom Setback Variance
Dear Mr. Garlin:
At the meeting held on Monday, May 24, 2021 the Carmel Board of Zoning Appeals Hearing Officer took the
following action regarding the Development Standards Variance (V) request filed by you for the property located at
1100 Arlington Court:
APPROVED: Docket No. PZ-2021-00059 V, Development Standards Variance approval for: 20-ft rear
building setback required, 14-ft granted.
Please note that, since the proposed sunroom will also encroach 1-ft into the 15-ft wide Legal Drain Easement that
runs along the rear of the lot, Consent to Encroach approval will be needed from the Hamilton County Drainage
Board (administered through the Hamilton County Surveyor’s Office).
Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development
Standards Variance approval is valid for three (3) years. By that time, either continuous construction of the
improvements must be underway, or a written request for a one-time, six-month extension of the approval must
have been received and approval granted by this Department. The expiration date of the approval is May 24, 2024.
Please include a copy of this letter with any permit application.
