The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the proposed sunroom addition will be on the rear facade of the existing dwelling on the side adjacent to a subdivision retention (wet)pond;the nearest neighbor to the rear of the parcel is across the retention pond; finish building materials will be compatible to the existing dwelling and the general neighborhood; both the Carmel Engineering Department and Hamilton County Surveyor have reviewed the planned expansion and do not object; and the Lexington Farms Homeowners Association reviewed and approved the addition"as submitted." 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the sunroom addition, a common residential feature, will be constructed with building materials and architecture that is compatible with the existing dwelling and neighboring houses and represents added value of investment in the dwelling, which, in turn, has a positive effect for the neighborhood. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: the parcel's shallow front-to-rear depth, the wedge-shape of the parcel and the location of the parcel at the bulb (turn-around)end of a cul-de-sac present practical difficulties to making the sunroom addition, which is a common home feature and could not be constructed without the requested minimal rear yard setback variance. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.PZ-2021-00059 V is granted,subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
