During the review, you requested we get a letter of determination from the State Building Commissioner to confirm the house could be built as a class 2 structure. This took a few months, but Craig Burgess, Indiana State Building Commissioner, and his team were able verify that the home on Carey Road, and future ones, could be classified as class 2 structures if they followed certain guidelines. Please find the Public Notice from the Department of Homeland Security included which clarifies when supportive living facilities like our Group Home are considered class 1 or 2 structures. They issued this at the time to apply to that situation and for future ones. This letter is to confirm with you that our current proposed Group Home at 11180 Westfield Boulevard Carmel, IN 46032 meets the criteria established by the State to be considered a Class 2 Residential structure as follows: 1. The structure contains one dwelling unit; 2. The structure is intended to be occupied by no more than one tenant. A tenant is someone, or some group, that possesses a structure or a unique portion of a structure. The number of tenants is not dependent on the number of occupants or the number or rental agreements entered, but the number of unique spaces being possessed. 3. The structure is intended to be used for nontransient residential occupancy; 4. The presence of employees at the structure is limited to providing supportive living services (services limited to supporting the regular use and enjoyment of the structure for residential purposes); and 5. The structure does not contain nonresidential areas that are not traditionally found in a dwelling unit.
