HomeMy WebLinkAboutExecuted - Tallyns Ridge HOA Agreement - April 2021Albany Village – Agreement with the Tallyn’s Ridge Homeowners Association Docket No. PZ-2020-0155 PUD April 2, 2021 This Agreement is between Lamb Property Developer, LLC and Logan Group, LLC (referred to as the “Applicant”) and Tallyn’s Ridge Homeowners Association (referred to as “HOA”). Whereas, the Applicant is proposing a new residential neighborhood planned unit development (referred to as “Albany Village PUD”) which is adjacent to a neighborhood called Tallyn’s Ridge. Whereas, the HOA and the Applicant have negotiated on multiple items to make the Albany Village development proposal before the Carmel City Council a compatible adjacent land use and a proposal that the HOA supports. To that end the Applicant has agreed to a list of commitments (referred to as “Commitments”) as specified below and the HOA has agreed to support the Applicants submittal before the Carmel City Council by writing a letter of support (referred to as “Support Letter”) to the Carmel City Council on or before April 11, 2021. Now therefore in consideration of the foregoing, the Applicant and the HOA have agreed to the following: 1. Applicant agrees to build a traffic calming device where Albany Village connects into Tallyns Ridge via Trahan Drive if approved by the City of Carmel Engineer. The device that the Applicant is proposing is an elevated speed table. 2. The Applicant agrees to pay for and plant four (4), 6’ to 7’ trees on the back 20’ of the properties described at 14344, 14356, 14380, 14392, and 14404 Trahan Drive (the “Tallyns Ridge Properties”) in a location as directed by the homeowner. The type of trees to be planted will be either Giant Green Arbor Vitaes, Norway Spruce or Canadian Hemlocks as decided by the Applicant. Once the trees are planted the trees are the responsibility of the individual Tallyns Ridge Property owners. These trees will be installed at the same time as the common area landscaping is being installed by the Applicant for Albany Village. The Tallyns Ridge Property owners must agree to give the Applicant access to their property to fulfill this obligation. 3. The Applicant agrees to require the builder of homes in Albany Village to install six (6), 6’ to 7’ trees on the back 20’ of the property west of and adjacent to the Tallyns Ridge Properties that will be either Giant Green Arbor Vitaes, Norway Spruce or Canadian Hemlock as decided by the Applicant. These trees will be installed when the builder is installing the landscaping for the homes directly west of the Tallyns Ridge Properties. 4. The Applicant agrees to pay the Tallyns Ridge Properties owners each $1,000. These funds will be paid at the time of the completion of the planting of the trees referred to in item 2 above. It would be the Applicants hope that the Tallyn Ridge Properties would use this for additional buffering on the back of their property, however, the Applicant is not requiring that. 5. The Applicant agrees to hire a certified tree arborist to advise the Applicant whether or not the large Oak tree behind 14344 Trahan Drive can be saved at a cost acceptable to the Applicant without losing any lots. 6. The Applicant agrees to pay to the Tallyns Ridge Homeowners Association $20,000. These funds will be paid at the time of the recording of the secondary plat. It was the Applicants thought that all of the other homeowners in Tallyns Ridge, besides the homeowners that are adjacent to our east property line, would benefit from these funds and would provide equity to your entire neighborhood and HOA. This could be used for increased landscaping or maintenance for the entire neighborhood at the discretion of the HOA board. 7. In the event the Carmel City Council does not approve the Zoning Request these Commitments set forth above are null and void.
