We are requesting a variance approval for 5-foot iron railing fence with stone corner posts and
columns. The railings match the house trim color. The additional 6 inches of fence height
creates a sense of scale when applied to other landscaping and the neighborhood. The property
is located at 135 Sylvan Lane, Carmel, Indiana 46032.
According to UDO Section 25.02.02(A) limits fences in the front yard of R-2 zoned property to
42 inches. Petitioner is requesting a fence 48 inches high with stone corner post of 6 feet and
intermittent columns of 4 feet 6 inches.

Statement of Variance Request
Petitioner ask to install a stone column metal fence in the front yard of the residence at 135
Sylvan Lane, Carmel, Indiana 46032. The fence will be 48 inches high and the stone columns 6
feet high at the corners and 4 feet 6 inches high in the middle spaced 12 feet apart. The fence
material will be black metal rails between the stone columns. The fence will be installed along
the south boundary of the lot (street side) and approximately 50 feet along the west and east
boundaries.

CARMEL ADVISORY BOARD OF ZONING APPEALS

The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because:
The location of the fence is permitted. The additional 6 inches of height to the fence and additional
height to the columns are consistent with the scale of the residence and neighborhood.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
The fence and columns are stone and iron rails, decorative and add value to the property and the
adjoining properties
3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical
difficulties in the use of the property because:
The scale of the fence as requested compared to the residence and neighborhood is attractive, decorative,
and appropriate.
DECISION
It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.
