PZ-2021-00105 V, PZ-2021-00106 V: Don Rigo Mexican Restaurant at Legacy Variances Dear Mr. Niemier: At the meeting held Monday, June 28, 2021, the Carmel Advisory Board of Zoning Appeals took the following action regarding the Development Standard Variances (V) filed by you for the property located at 7299 E. 146th Street: APPROVED: Don Rigo Mexican Restaurant at Legacy - Development Standards Variance approvals for: 1. Docket No. PZ-2021-00105 V: Maximum 15’ building setback allowed, 30’ granted, and 2. Docket No. PZ-2021-00106 V: 77 parking spaces required, 70 granted. Please be advised that per Article 9.15 of the Unified Development Ordinance, the aforementioned Development Standards Variance approvals are valid for three (3) years. By that time, either continuous construction of the improvements must be underway, or a written request for a one-time, six-month extension of the approval must have been received and approval granted by this Department. The expiration date of the approval is June 28, 2024. Please include a copy of this letter with any permit application.
