DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS Docket No.: PZ-2021-00106 V Petitioner: Don Riqo Properties, LLC 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: Granting of the requested Development Standards Variance regarding the maximum building setback will not be injurious to the public health, safety, morals, and general welfare of the community and the proposed development of the subject property is consistent with similar uses in the surrounding area. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: Adjacent properties will not be affected in a substantially adverse manner because the proposed development of the subject property will actually benefit the adjoining properties by attracting more business and customers to the area. Allowing 70 parking spaces, instead of 77 parking spaces, will not negatively impact the value of adjacent properties. 3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical difficulties in the use of the property because: Strict application of the existing Zoning Ordinance would result in an unnecessary hardship, not made by Petitioner, in the development of the subject property because aligning the drive lanes on the subject property with the existing drive lanes on the adjoining property decreased the number of parking spaces available on the subject property. DECISION It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ-2021-00106 V is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
