BPW 06-16-21-02 RESOLUTION OF THE CITY OF CARMEL BOARD OF PUBLIC WORKS AND SAFETY ACKNOWLEDGING AGREEMENT BETWEEN CITY AND VENDOR WHEREAS, pursuant to Indiana Code 36-1-4-7, the City of Carmel, Indiana (“City”), is authorized to enter into contracts; and WHEREAS, pursuant to Indiana Code 36-4-5-3, the City’smayor may enter into contracts on behalf ofthe City; and WHEREAS, pursuant to his authority under Indiana law, the City’smayor, the Honorable James C. The existing approach from 106th will be kept and utilized for service and maintenance vehicles (exhibit attached). The Department of Engineering recommends that the Board approve the requested lane restriction , street closure and open pavement cut conditioned upon the following requirements: • The project’s contractor shall comply with the provisions of Carmel City Code 6 -227(a)(1), 6-227(a)(8) and 6-227(b). • Petitioner agrees to post proper lane restriction signage during the duration of the work. Traffic shall be maintained at all times during the restrictions. • Any damage to the existing improvements within the City of Carmel right of way shall be restored to the satisfaction of the City when work is completed. • Emergency access to adjoining properties of the work site shall remain in place at all times. We are requesting a waiver from the 15’ setback requirement along the west side of the detention basin. Due to constraints of the site, we have maximized the size of the basin, and cannot meet this 15’ dimension. (Section 701.07) 3. Comment 47. We are requesting a waiver to provide a secondary control structure for offsite run- off. No dedicated control structure for off-site water has been utilized because most of the water flowing through the detention system is onsite runoff that is being treated as off-site water. As such, the top of the control structure is the secondary weir. We are maximizing detention within the constraints of the project. All proposed release rates are reduced from current conditions. (Section 302.05) 4. Comment 50. We are requesting a waiver of the requirements for infiltration analysis under the permeable paver section. These pavers are intended only as a stormwater BMP and are not intended to impact detention requirements.
