DEPARTMENT REPORT
MONDAY, JULY 26, 2021
(V) Magnolia Building Height Variance.
The applicant seeks the following development standards variance approval:
5. Docket No. PZ-2021-00121 V UDO Section 2.36 Maximum 35-ft building height when
adjacent to single family residences allowed, 36- to 42-ft requested for condominiums. The site is
located at approximately 731 S. Rangeline Rd. and 726 Pawnee Rd. It is zoned C2/Mixed Use District.

General Info & Analysis:
The Petitioner proposes to construct a new residential development consisting of six condominium buildings for
30 total units. Each building will have five units with garage parking located at the ground level and three floors
of living above. This site is bordered by Carmel City Center to the west (zoned C-1), Carmel United Methodist
Church to the north (partially zoned B-3 and R-2), residential homes in the Newark subdivision zoned R-2 to
the east and southeast, as well as Ace Hardware to the immediate south (zoned C-2). Please see the

At the April 15, 2021 Plan Commission Hearing Officer meeting, Docket No. PZ -2020-00074 DP/ADLS:
Magnolia was approved subject to finalizing outstanding review comments and receiving any necessary site
variances. This was for the project’s Development Plan and ADLS (architecture, design, lighting, landscaping,
and signage) applications.
Variance for Building Height:
The Unified Development Ordinance allows for a maximum building height of 35-ft for buildings within the
C2/Mixed Use District, when adjacent to single family residences. The proposed heights are 36 feet to 42 feet,
for a variance of 1 foot through 7 feet. This is a variance of 2.8% to 20%.
The tallest building, due to grade change, will be Building 6 at the southeast corner of the site. All buildings
should be 36’ tall, with some corners up to 42' due to the retaining walls.
A big factor for the varying building heights is the resulting topography and slope of the site. The grade level of
the buildings changes as you go south and east on the site. Due to the required grading on the site to
accommodate for stormwater management requirements, retaining walls are required, and that, in turn, affects
the heights of the buildings when measured from ground level.
The Petitioner addressed all the planning/zoning review comments, and the Planning Dept. supports the
variance request.

The Dept. of Community Services (DOCS) recommends positive consideration of Docket No. PZ-2021-00121
