The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: Given the nature of the proposed project and placement within our property and the quality of the work and materials used I don't believe the variance will be injurious to the public health, safety, morals and general welfare of the community. 2. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: With the Drainage&Utility Easement running approximately 5'4"behind the entire length of the rear of our house and UDO section 5.02.B.1 requiring minimum 3'setback from easement it severely limits our ability to do any improvements or enhancements in the backyard of our home. Virtually all improvements would require a variance.
