• L FINDINGS OF FACT SHEET - DEVELOPMENT STANDARDS VARIANCE CARMEL ADVISORY BOARD OF ZONING APPEALS (Petitioner to fill out 1-3 + first two blanks) Docket No.: PZ-2021-00122 124 125 Petitioner: Jarreth and Kelsey Vance 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: PZ-2021-00122 - The function of the cul-de-sac and accessibility to the lot will not be adversely affected from its current state due to the only encroachment to the prescribed setback being an open-air front porch. PZ-2021-00124 - The accessibility to the lot will not be adversely affected from its current state due to design provisions and the irregular shaped parcel. PZ-2021-00125- This is an existing condition. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: PZ-2021-00122- The form and function of the cul-de-sac will not be adversely affected from its current state while allowing for a higher valued residence on the irregular shaped parcel. PZ-2021-00124 - The form and function of the cul-de-sac will not be adversely affected from its current state while allowing for a higher valued residence on the irregular shaped parcel. PZ-2021-00125- This is an existing condition. 3. The strict application of the terms of the Unified Development to the property will result in practical difficulties in the use of the property because: PZ-2021-00122- The property has an irregular shape creating a curved setback and inefficient layout on the lot. PZ-2021-00124 - The property has an irregular shape meaning that a traditionally orientated building creates an inefficient side yard. PZ-2021-00125- This is an existing condition. DECISION IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No. PZ-2021-00122; 00124; 00125: is granted, subject to any conditions stated in the minutes of this Board, which are incorporated her in by reference and made a part hereof.
