1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of
the community because: it requests mostly a 1 foot increase in building height for the 6 proposed condo
buildings. Additionally, it requests up to 7 feet taller when measured from the base of the retaining wall on
the 2 southernmost condo buildings.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because: the property will be maintained as a for sale residential
development with significantly higher value then the previous residential use.
3. The strict application of the terms of the Unified Development Ordinance to the property will result in practical
difficulties in the use of the property because: the•agreed upon architectural style required a parapet that
increases the height an additional foot beyond the required maximum. Due to grading on site, in order to
properly manage storm water, in accordance with the department of engineering, retaining walls were
utilized adjacent to some of the buildings and resulting in the additional height from the base of the wall.
DECISION
It is therefore the decision of the Carmel Board of Zoning Appeals that Development Standards Variance Docket No.
f z-2021 -00 i 2t ✓ is granted, subject to any conditions stated in the minutes of this Board,which are
incorporated herein by reference and made a part hereof.
