HomeMy WebLinkAboutCC-01-03-00-02 Council AttorneyResolution No. cc-01-03-00-02 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA WHEREAS, pursuant to Chapter 3, Article 1, Division II, Section 3-16 of the Carmel City Code, and Indiana Code 36-4-6-24, the Common Council of the City of Carmel has the authority to appoint and contract with an attorney to serve as Council Attorney; and, WHEREAS, the Common Council of the City of Carmel desires to contract with McHale, Cook & Welch, p.c. to serve as Council Attorney; and WHEREAS, McHale, Cook & Welch, p.c. desires to serve as Council Attomey for the Common Council of the City of Carmel; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, as follows: Section I: McHale, Cook & Welch, p.c. is hereby appointed to serve as Council Attomey for the Common Council of the City of Carmel and shall so serve at the pleasure of the Council and pursuant to an annual written agreement. Section II: As Council Attorney, McHale, Cook & Welch, p.c. shall provide legal assistance in preparation of Resolutions, Orders and Ordinances that might be requested by members of the Common Council. Section III: As Council Attorney, McHale, Cook & Welch, p.c. shall prepare such Resolutions, Orders and Ordinances at the request of members of the Common Council. Section IV: As Council Attorney, McHale, Cook & Welch, p.c. may represent the Common Council in any litigation to which the Common Council members may be a party as a consequence of their collective or individual official responsibilities. Upon being served with a notice of claim and civil process wherein the Common Council or any of its members is named as a party by reason of their official capacities, the City Attorney shall immediately forward a copy of such notice to the President Pro Tempore of the Council. Upon receipt of such notice, the President Pro Tempore may, after consultation with the Council Attorney, direct the City Attorney to represent the Council, direct the Council Attorney to assist the City Attorney in the representation of the Council, or direct the Council Attomey to represent the Council in such claim or litigation. The actions of the President Pro Tempore pursuant to this section are final unless overruled by the Common Council. Section V: As Council Attorney, McHale, Cook & Welch, p.c. shall provide to individual Council members legal advice on any question regarding the official work of said Council members. Section VI: The Council Attorney shall attend Council and Council Committee meetings as requested by the Councik oc I°re~'~eo~- 'Pro T~.mporC. Section VII: The Council Attomey shall work in cooperation with the City Attomey as directed by the Council, or ~ re 5 itch+ ~ co Tern Fore, Section VIII: The Council Attomey shall perform all those other responsibilities set forth in the Indiana Code, the Carmel City Code and as directed by the Council regarding his/her relationship to the Common Council. Section IX: This Resolution shall be in full force and effect from and after its passage and signing by the Mayor.
