CC-10-04-99-02 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA DECLARING THE NEED FOR A HOUSING AUTHORITY IN THE CITY OF CARMEL AND PROVIDING FOR THE ESTABLISHMENT OF THE CARMEL HOUSING AUTHORITY WHEREAS, Indiana Code Sections 36-7-18-1 et seq., permit a unit of local government to establish a housing authority by resolution of its fiscal body declaring a need for such an authority; and WHEREAS, pursuant to Indiana law, the Common Council of the City of Carmel, Indiana, is the City's fiscal body; and WHEREAS, pursuant to Indiana Code Section 36-7-18-4, a governmental unit's fiscal body may adopt a housing authority resolution if it finds that unsanitary or unsafe dwelling accommodations are inhabited within the governmental unit; and WHEREAS, in determining whether dwelling accommodations are unsafe or unsanitary, the fiscal body may consider the degree of overcrowding, the percentage of land coverage, the light, air, space and access available to inhabitants, room size and arrangement, availability of sanitary facilities, and the extent to which conditions in such buildings endanger life or property by fire or otherwise, as well as other relevant conditions and circumstances that are determined by the fiscal body, in its discretion, to cause a dwelling to be unsafe or unsanitary. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana, as follows: 1. The foregoing recitals are fully incorporated herein and made a part hereof. 2. After conducting a public hearing as required by Indiana Code Section 36-7-18-4, the Common Council finds that unsanitary or unsafe dwelling accommodations are inhabited within the City, and that it will serve to protect the health, safety, comfort and general welfare of the citizens of the City of Carmel to provide for the establishment of a housing authority pursuant to Indiana law. 3. The Common Council hereby declares that there is a need for a housing authority in the City of Carmel. 4. The City Attorney is hereby directed to prepare an ordinance establishing the Carmel Housing Authority and to place such ordinance on the Council's agenda. 5. This Resolution takes effect upon its passage by the Common Council. However, the Carmel Housing Authority shall not be authorized to transact business or exercise its powers under State law until the Carmel Housing Authority ordinance referenced above has been duly adopted and approved.
