A RESOLUTION OF THE COMMON COUNCIL
OF THE CITY OF CARMEL, INDIANA
Authorizing The Carmel / Clay Board of Parks and Recreation to Convey .043 Acres
to Hamilton County for the Reconstruction of Bridge #139
WHEREAS, Hamilton County (the "County") has determined that it is necessary to reconstruct
Bridge #139 on Gray Road and the drainage ditch that flows into Cool Creek near Gray Road, noah of
116th Street and the City's utility access drive; and
WHEREAS, the County has requested that the Carmel / Clay Board of Parks and Recreation (the
"Parks Board") convey to the County, by QuitClaim Deed, pursuant to IC 36-1-11-8, 0.043 acres of real
estate owned by the Parks Board (the "Property") so that the County may perform such reconstruction and
ongoing maintenance of Bridge #139 and the adjoining drainage ditch; and
WHEREAS, the Parks Board has, by its Resolution No. 8-11-98-03, dated August 11, 1998,
resolved to execute and deliver to the County a quit claim deed conveying the Property to the County; and
WHEREAS, the City's consent is required before the Parks Board may convey the Property to the
County;
WHEREAS, the reconstruction of Bridge #139 and the adjoining drainage ditch is of benefit to
the City of Carmel and its residents because it will (i) improve vehicular traffic flow along Gray Road and
(ii) provide better drainage in the vicinity of Bridge #139.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Cannel,
Indiana, as follows:
1. The City authorizes and consents to the Park Board's conveyance to the County of the
following described real estate, to wit:
A part of the Southwest Quarter of Section 33, Township 18 North, Range 4 East,
Hamilton County, Indiana, described as follows: Beginning at a point on a south line of
the owner's land that is North 0 degrees 48 minutes 30 seconds East (assumed bearing)
430.00 feet along the west line of said section and South 89 degrees 11 minutes 30
seconds East 46.33 feet from the South west corner of said section, which point of
beginning is also the east boundary of Gray Road; thence North 0 degrees 59 minutes 05
seconds East 94.86 feet along the boundary of said Gray Road; thence North 89 degrees
00 minutes 55 seconds West 1.62 feet along said boundary; thence North 0 degrees 48
minutes 30 seconds East 18.71 feet along said boundary to the northwestern line of said
owner's land; thence North 43 degrees 37 minutes 13 seconds East 24.42 feet along said
northwestern line; thence South 0 degrees 48 minutes 12 seconds West 131.49 feet to a
south line of said owner's land; thence North 89 degrees 11 minutes 30 seconds west
15.28 feet along said south line to the point of beginning and containing 0.043 acres,
more or less.

This Resolution is made expressly contingent upon the County, through its lawful
representatives, duly passing and executing a resolution substantially identical to this
Resolution, as required by Indiana Code 36-1-11-8.
This Resolution shall be in full force and effect from and after the latter of: (i) the date of its
passage, execution by the Mayor, and any publication as may be required by law, or (ii) the
date on which the County complies with paragraph 2 hereof.
