TRANSFER OF FUNDS BY THE CARMEL CITY COURT
WHEREAS, an amount of $3,975.00 is needed to cover expenses in the Carmel City
Court Budget (General Fund) line item # 632.01 (Computer Equipment) and,
WHEREAS, the Carmel City Court has excess funds to transfer to line item # 632.01
(Computer Equipment) line item:
Acct. # 220.00 (City's Share of Health Ins.) in the amount of $3,975.00
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Carmel, Indiana, that the Carmel City Court be authorized to transfer:
$3,975.00 from line item # 220.00 (City's Share of Health Ins.)
into
line item # 632.01 (Computer Hardware)

system visit. Below is a summary of
our findings and actions·
Terry Crockett, by his own admission, removed the Domain Administrator rights
from both Kim Rott's (site Administrator) and Data Design's accounts. This
resulted in the Court having no control over adding or removing users. Neither
the Court staff nor Data Design .was made aware that the Administrator
permissions had been removed.
Data Design could not guarantee or authenticate the Court data integrity due to
these permission modifications.
In order to secure the Court data, we had to move the database to one of the
court's computers, modify permission levels and access dghts to allow only Court
personnel and Data Design to access the software.
Since the database has been moved off of the City server, a new backup system
must be purchased and installed. Currently, there is no automated backup
system.
Due to security issues the Court may want to consider setting up a local network
independent of the city network. This would involve the purchase and installation
of a dedicated server, which would reside in the court offices. A workstation
(e.g., Judges machine) would be interfaced with the City Server for purposes of
accessing common services.

During this process, we also found evidence that the software had been
modified. In accordance with numbered paragraph 16 of our contract, we cannot
be responsible for the proper operation of the system, since we did not perform
these modifications. It does appear that none of the critical areas of the software
were tampered with, so we have hopefully secured your software and data
before any serious damage was done.
We are at a loss to explain why Mr. Crockett took such actions. We have, and
will continue to offer our cooperation to him and any other City staff or
administrator. We can not, however, allow such unauthorized access and
tampering with our proprietary software, and your data. Such meddling by an
unauthorized and untrained individual is an invitation for catastrophe.
We welcome your calls to discuss this event further and provide you with more
specific information. We only desire to prevent such incidents from happening in
th,e future, as well as ensuring and maintaining your data's security and integrity.

In accordance with our meeting on May 19, 1999, I have researched the available, in house options for a existing
hardware server capable of running Windows NT Server 4.0 for the purposes of supporting your Courtworks software. I
regret to inform you that Information Systems has nothing suitable nor available for this purpose.
As I understood from the meeting, the next option is for the Court to obtain a system as required by, specified by, and
purchased from Data Design.

RE: ACCOMPANYING RESOLUTION TO TRANSFER FUNDS
DATE: JUNE 11, 1999
I am submitting, for your approval, the accompanying resolution to transfer funds within
the City Court budget. It is made necessary by problems which have occurred after the
installation of our new computer system in the Court, which problems are due to our
attempts to use the City server. Security issues both for the Court and for other City
offices and departments have arisen out of our use of that server.
Last year, when we ~nalized our computer (hardware and software) purchase with our
service provider, Data Design, we were advised by Terry Crockett that the Court did not
need its own server. We were advised, and it was strongly recommended to us, that we
should use the City server. Earlier this Spring, Data Design proceeded with installation
of our system, using the City server. We experienced a number of problems, some
related to that server, some not. After several attempted "fixes", I received the letter from
Mr. Bendure of Data Design, dated May 6, 1999, which is attached to this Memo. This
prompted a meeting between myself, my Clerk, Data Design personnel, Terry Crockett
and Joe Staehler. That meeting took place May 19, 1999. It was decided at that meeting,
by all of the parties present, that the Court should have its own server, as is acknowledged
in Mr. Crockett's memo dated May 25, 1999.
Data Design has submitted its proposal for providing the equipment which we need. To
cover the cost of this, we need to transfer $3,975.00 into our line item #632.01 (Computer
Equipment). We have sufficient funds to transfer available from our line item #220.00
(City's Share of Health Insurance). This is because Mrs. Wagner, the Court's part-time
Deputy Clerk, has not yet converted from part-time to full-time status. Therefore, we
have not had to use the funds eannarked for her benefits. We do not anticipate having to
use them before the end of the year, either.
