A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA
Regarding Western Clay Township
WHEREAS, the Common Council of the City of Carmel is elected by the City's residents
and performs the City's legislative functions; and
WHEREAS, in 1960, the Town of Carmel and Clay Township, at the request of Clay
Township, entered into a joinder agreement CJoinder Agreement") wherein the Township became
joined to the City for development and zoning purposes; and
WHEREAS, the Town of Carmel and Clay Township annually renewed the Joinder
Agreement from 1961 to 1976; and
WHEREAS, the City of Carmel and Clay Township have annually renewed the Joinder
Agreement from 1976 to date; and
WHEREAS, pursuant to the Joinder Agreement, the Carmel City Plan Commission has the
authority to promote the orderly development of the City of Carmel and Clay Township; and
WHEREAS, legislation is currently being considered by the Indiana legislature which would
add four (4) non-elected members to the Common Council of the City of Carmel, which members
would ostensibly vote only on land and zoning issues affecting the unincorporated western portion of
Clay Township.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel,
Indiana, as follows:
1. The Common Council strongly believes that the concept of adding members
with limited legislative authority to the City' s duly elected seven (7) member Common Council is not
in the City's best interests nor in the best interests of the City's residents, whose well-being would be
affected by the decisions made by these non-elected appointees.
2. The Common Council opposes the addition of any members to its body that are
not City residents and not properly elected by City residents.
3. The Common Council supports the concept of having one corporate entity
responsible for both the taxation of, and the planning for, western Clay Township.
4. The Common Council encourages the residents of western Clay Township to
seek a solution that creates a situation wherein the planning, zoning, taxing authority and roads are
under a single jurisdiction.

5. If the residents of western Clay Township decide to seek the voluntary
annexation of their property into the City, and such annexation request meets the requirements of
Indiana Code 36-4-3-5, the Common Council supports a January 1, 2003 effective date for such
annexation.
6. This Resolution shall be in full force and effect from and after its adoption and
approval by the Mayor.
