HomeMy WebLinkAboutCC-11-16-98-01 TOF/ParksResolution No. CC- 11-16-98-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL TO EFFECT A TRANSFER OF $555,000.00 FROM THE PARK RECREATION FUND TO THE PARK NONREVERTING CAPITAL FUND WHEREAS, the Park Joinder Agreement Under Interlocal Cooperation Act between the City of Carrnel, Indiana, and the Trustee of Clay Township, Hamilton County, Indiana (the "Joinder Agreement"), provides that the Common Council of the City of Carreel, Indiana (the "City"), and the Township Board of Clay Township (the "Township Board") shall determine and provide the revenues necessary for the operation of the Carmel-Clay Board of Parks and Recreation (the "Park Board"), and the Camel- Clay Department of Parks and Recreation (the "Park Department "); and WHEREAS, the Park Board passed Resolution No. 3-10-98-01 whereby it requested the City and the Township Board to appropriate Six Hundred and Thirty Thousand and no/100' s Dollars ($630,000.00) from the unspent balance of the Park Recreation Fund 1312 into Capital Outlays, classification IV (4), line item 4(c), Improvements Other than Buildings within the same fund 1312; and WHEREAS, the City and the Township Board each passed and adopted resolutions and took all actions necessary to comply with the Park Board's request; and WHEREAS, the Park Board is proceeding with the expenditure of $75,000.00 of the $630,000.00 appropriated, the balance of which is necessary for the development of the Monon Corridor, defined below; and WHEREAS, the City of Carmel continues the purchase of the Monon railway corridor from 96th Street through 146th Street within Clay Township, Hamilton County, Indiana (the "Morton Corridor"); and WHEREAS, the Park Board has passed and adopted Resolution No. 10-15-98-02 requesting that the City and the Township Board transfer $555,000.00 from the Park Recreation Fund 1312, Capital Outlays, classification IV (4), Line Item 4(c): Improvements Other than Buildings, into the Park Non-reverting Capital Fund 1215, pursuant to Indiana law; and WHEREAS, the Township Board has noticed a public hearing for its November 16, 1998 meeting at which it will consider a transfer of Five Hundred Fifty Five Thousand and no/100' s Dollars ($555,000.00) from the Park Recreation Fund 13 12, Capital Outlays, classification IV (4), Line Item 4(c): Improvements Other than Buildings to the Park Non-reverting Capital Fund 1215; and WHEREAS, I.C. 36-10-3-20 and I.C. 36-10-7.5-18 authorize the transfer of funds imo the Park Non-reverting Capital Fund 1215, the establishment of which is codi~ed in Chapter 2, Article 4, Section 2-120 of The Carmel City Code. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel that the Clay Township Board may, should it choose to do so, transfer Five Hundred and Fifty Five Thousand and no/100' s Dollars ($555,000.00) from the Park Recreation fund 1312, Capital Outlays, classification IV (4), Line Item 4(c): Improvements Other than Buildings, to the Park Non-reverting Capital Fund 1215, in accordance with Indiana law and the Joinder Agreement. MONONTransferSpec .Nonreverting MEMO TO: FROM: DATE: SUBJECT: Mayor Brainard, City Council Members, Township Trustee, Township Board Members Randy Auler, Director November 4, 1998 Park Board Resolution to Transfer Funds and Resolution of Interest Transfer of Funds From the Park Recreation Fund to the Non-Revertin~ Capital Fund In 1997, the department had $555,000 budgeted in the Recreation Fund 4.C. (Improvements Other Than Buildings) for the construction of the Monon Trail. As you may recall, we did not have the project under contract and could not encumber the money at that time. Earlier this year, we requested an additional appropriation of $555,000 from the City Council and Township Board for the Morton Trail, in essence, re-appropriating the budgeted money. This was approved and the $555,000 is now in the 1998 Recreation Fund budget 4.C. (Improvements Other Than Buildings). It appears that we will not have the Monon Trail project out-to-bid and under contract by December 31, 1998. This request to transfer the $555,000 from the 1998 Recreation Fund budget to the Non-Reverting Capital Fund budget is in accordance with our philosophy of the Recreation Fund Budget serving as our operating budget and the Non- Reverting Capital budget as the Capital Improvement budget. Resolution of Interest to Purchase Property The park board passed a resolution of interest for the Monon Trailhead North parking site at its August park board meeting. The site is an undeveloped property of about two acres at 142"d Street and Rohrer Road adjacent to the Monon Trail on its' west side. This resolution of interest, if approved by the City Council and Township Board, enables us to obtain appraisals on the property and move forward to potentially purchase this property.
