Based on our review of the Sign Ordinance (in particular, Section 25.7.06) and Indiana case law, I have determined that: 1. Your existing sign falls into the category of a "legal non -conforming sign" under the Sign Ordinance; and 2. In conjunction with the County's 116th Street improvement project, you may relocate this sign to a new position on your property which will afford it comparable visibility, so long as you do not otherwise alter or expand its size or appearance. Under the Sign Ordinance, you will remain obligated to keep the relocated sign in good repair and in a safe condition. if you should desire in the future to relocate the sign again for any reason, it would lose its status as a "legal non -conforming sign" and you would have to apply for a variance.
