HomeMy WebLinkAboutCC-03-16-98-02 Add Approp/ParksResolution No. CC-03-16-98-02 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL TO ACKNOWLEDGE AND SLIPPORT AN ADDITIONAL APPROPRIATION OF FUNDS (AS AMENDED) WHEREAS, the Park Joinder Agreement Under Inte~ocal Cooperation Act between the City of Carmel, Indiana, and the Trustee of Clay Township, Hamilton County, Indiana (the "Joinder Agreement"), provides that the Common Council of the City of Carreel, Indiana and the Township Board of Clay Township shall determine and provide the revenues necessary for the operation of the Carmel-Clay Board of Parks and Recreation (the "Board"), and the Carreel-Clay Department of Parks and Recreation (the "Department "); and WHEREAS, the Park Board has acquired the fee simple interest in 14.24 acres of real property located in the City of Carmel, Indiana on the East side of River Road with its northern boundary at or about Rail Timber Trail and its southern boundary at or about three hundred (300) feet south of Bethel Morris Trace, commonly referred to as the "River Trail", anticipated to be developed in conjunction with the Hamilton County park commonly known as "River Road Park"; and WHEREAS, the City of Carmel is in the final stages of purchasing the Monon railway corridor from 96th Street through 146th Street within Clay Township, Hamilton County, Indiana (the "Monon Corridor"); and WHEREAS, the Park Board has the responsibility to develop the River Trail into a passive park with a pedestrian and bike trail and the Morton Corridor into a linear park, such development anticipated to occur in 1998 (the "Projects"); and WHEREAS, the Township reports that there is approximately Six Hundred and Ninety Thousand and no/100's Dollars ($690,000.00) in the unspent balance of the Recreation Fund (the "Unspent Balance"), from which fund the Park Board operates the Carmel/Clay Department of Parks and Recreation; WHEREAS, the Park Board has determined that it will be necessary to appropriate an amount of money from the unspent balance into Capital Outlay,, Line Item 440(C): Improvements Other than Buildings, sufficient to award the construction contracts for the Projects. WHEREAS, the Board and the Department have requested the Trustee to notice a meeting at which the Clay Township Board will consider an additional a opfiation request for a sum not to exceed Six Hundred and Thirty Thousand and n .. 's Dollars ($630,000.00) from the unspent balance of the Recreation Fund and into thl Capital Outlay classification, Line Item 440(C): Improvements Other than Buildings of the Recreation Fund: WHEREAS, the Trustee and the Township Board will notice such additional appropriation for consideration at a public meeting; and WHEREAS, Board and the Department have requested that the Common Council approve of their request for an additional appropriation as set forth above. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel that the Clay Township Board may, should it choose to do so, appropriate from the unspent cash balance of the Recreation Fund an amount not to exceed Six Hundred and Thirty Thousand and no/100' s Dollars ($630,000.00) the Capital Outlay classification, Line Item 440(C): Improvements Other than Buildings of the Recreation Fund in accordance with Indiana law and the Joinder Agreement.
