STREET DEPARTMENT WHI~-REAS, an amount of $9,350.00 is needed to cover said expenses in the 1998 Street Department Budget line Item #500-60 Traffic Light Repairs, and WHEREAS, the City of Carmel has excess funds in the amount of $9,350 in the operating balance of the Motor Vehicle Highway Fund to appropriate for insurance reimbursement, NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Cannel, Indiana, the Council authorizes the following additional appropriation for the Street Department $ 9,350 from the operation balance of the MVH Fund to #500-60 Traffic Light Repairs PASSED by the Common Council of the City of Cannel, Indiana this ;~r / day of Je~,-~c~7,~ ,1998, by a vote of -5 ayes and ~ nays. ~~_COMM~ON CIL . Cannel, IN ~6032 Date: January 30, 1998 To: From: Honorable Mayor Jim Brainard Honorable Members of Camel City Coundl David K!ingensmith Re: Appropriation in Account #500.60 Traffic Signal Maintenance Sometime in the past, the traffic signal box at 116~ and College Avenue was struck by a vehicle. We do not know when this happened, nor do we know who hit it, so we are unable to turn it in to their insurance company. We therefore turned it in to ours. We have received a check from ITT Hartford Insurance company for the amount of $9,350.00, which is the cost of repair to the signal box less a $500 deductible. (See attached estimate from Midwestern Electric). It is our understanding that before we can spend this money, it will need to be appropriated back to our Account #500.60 (See attached "Appropriations- Insurance Claim Proceeds~). We therefore respectfully request that this be done at the City Coundl Meeting of February 23, 1998, so we may have Midwestern make these much-needed repairs. Thank you. COMMERCIAL * STREET LIGHTING * TRAFFIC SIGNALS · MAINTENANCE AN EQUAL OPPORTUNITY EMPLOYER /~P_PROPRIAT,!_.O..N.S .-INSURANCF C~ AIM PROCEEDS IC 6-1.1-1 8-7 sets forth the procedure that shall be observed when appropda~ng insurance claim proceeds to replace property, as follows: "Notwithstanding the other provisions of this chapter [6-1.1-1 8-1 - 6-1.1-1 8-11]. the appropriating body of a political subdivision may appropriate funds received from an insurance company if: (1) the funds are received as a result of damage to property of the political subdivision; and (2) the funds are appropriated for the purpose of repairing or replacing the damaged property. However, this section applies only if the funds are in fact expanded to repair or replace the property within the twelve (12) month pedod after they are received." Where appropriations are made for insurance claim proceeds, this need not be advertised nor approved by the State Board of Tax Commissioners.
