WHEREAS, Indiana Code 31-9-9 permits landowners to petition their municipal works board requesting the installation, maintenance and operation of a system of omamental street lights and posts with underground wiring; and WHEREAS, Indiana Code 36-9-38 permits landowners who petition their municipal works board requesting the installation, maintenance and operation of an omamental street light system to seek the establishment of an improvement district and the funding of such municipal improvement pursuant to Indiana law; and WHEREAS, the purported owners of at least sixty percent (60%) of the city blocks contained in the area generally known as the Cool Creek North Subdivision and generally bounded by the intersections of 131 st Street and Hawthome, 131 st Street and Cool Creek Court, Tulip Poplar Crest and Smokey Row and Ironwood Drive and Smokey Row, Carreel, Indiana have now prepared and presented such a petition ("Petition") as is described above to the Carmel Board of Public Works and Safety ("Board") for its consideration, a copy of which Petition is attached hereto and made a part hereof; and WHEREAS, Indiana Code 36-9-9-3 requires the Board, upon receipt of such a Petition, to adopt a declaratory resolution for the making of the improvement described therein, subject to the Board' s fight to later rescind or modify such resolution in accordance with Indiana law. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City of Carmel, Indiana, that in conjunction with Indiana law, the improvement described in the Petition be made. ADDENDUM TO PETITION FOR SIDEWALK, CURB, STREET OR STREET LIGHTING IMPROVEMENTS A detailed description of the above improvement is: All current street lights will be replaced by a type of light fixture with the following (or substantially similar) characteristics: * Approximately 12.5 feet in height * 150 Watt high pressure sodium light * Aluminum pole * Concrete Base *"Acom" style light fixture * Underground wire set in conduit * Estimated useful life = 50 years Additionally, up to twelve (12) additional street lights could be installed in areas needing additional lighting. Entrances to the district will be included in this list. Current neighborhood entryway signs will be replaced by a low maintenance, long-lived altemative which includes additional lighting. Likely brick and stone construction, though design and materials are not yet ~nalized.
