A RESOLUTION OF THE CITY OF CARMEL, INDIANA BOARD
OF PUBLIC WORKS AND SAFETY AUTHORIZING THE
EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT FOR BY THE
MAYOR OF THE CITY OF CARMEL, INDIANA
WHEREAS, the City of Cannel is in the process of acquiring within the
boundaries of the City of Cannel (the "City") and the Township of Clay a railroad corridor
between 146m Street on the north and 96th Street on the south C'Monon Corridor"); and
WHEREAS, a class action lawsuit has been brought on behalf of all persons in
Indiana owning property adjacent to the railroad corridor C'Class Action"); and
WHEREAS, on December 19, 1996, Judge Hughes of Hamilton Superior Court
#3 (the "Court") established a subclass of the Class Action for owners of property
adjacent to the Monon Corridor (the "Subclass"); and
WHEREAS, the Carmel-Clay Board of Parks and Recreation (the "Park Board")
has accepted responsibility to develop the Monon Corridor as a linear park; and
WHEREAS, the Park Board, the City, the Class Action and the Subclass all have
an interest in obtaining a survey of the Monon Corridor; and
WHEREAS, the Subclass, the Class Action and the City, on February 14, 1997,
successfully obtained an Order from the Court approving entry upon the Monon Corridor
by a registered land surveyor for the purpose of a land survey; and
WHEREAS, the ParkBoard's interest in a survey of the Monon Corridor is
related solely to its development while the interests of the City, the Subclass and the Class
Action are for purposes of acquisition and sale; and
WHEREAS, Congdon Engineering is willing to provide a survey which will serve
the interests of all interested parties pursuant to a Professional Services Agreement; and
WHEREAS, all parties have not yet approved the final form of a Professional
Services Agreement; and
WHEREAS, in the interest of expediency, all parties must be prepared to execute
the Professional Services Agreement as soon as is possible upon approval of the final

NOW, THEREFORE, BE IT RESOLVED by the City of Carmel, Indiana Board
of Public Works and Safety
that the Mayor of the City of Carmel, Indiana is hereby authorized to execute a
Professional Services Agreement with Congdon Engineering to survey the Monon
Corridor, provided said Agreement is on a form approved by the Carmel City Attorney
prior to execution and the City's obligation thereunder does not exceed $40,000.
