HomeMy WebLinkAboutCC-09-02-97-01 Amend 2020 Comp Resolution No. CC-09-02-97-01 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA CHANGING ORDINANCE NO. D-1282-97 TO Z-322 WHEREAS, on May 19, 1997, the Common Council passed Ordinance No. D- 1282-97 implementing the policies contained in the 2020 Vision Comprehensive Plan relating to certain areas designated in the Plan for low intensity residential development, a copy of which is attached hereto as Exhibit A (the "Ordinance"); and WHEREAS, the Ordinance implemented policies affecting zoning and was incorrectly numbered D-1282-97; and WHEREAS, the Ordinance should have been numbered Z-322 to reflect the nature of the Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Carmel, Indiana that Ordinance No. D-1282-97, passed by the Common Council on May 19, 1997 is hereby re-numbered and shall be known as Ordinance No. Z-322. (AS AMENDED FROM ORIGINAL ORDINANCE D-1282-97) WHEREAS, the 2020 Vision Comprehensive Plan was approved and recommended by the Carmel Clay Plan Commission on August 20, 1996, and duly approved by resolution of the Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of the City of Carmel and Clay Township; and WHEREAS, the 2020 Vision Comprehensive Plan contains policies relating to certain areas of western Clay Township which recommend that the land in such areas be used for low intensity residential development; and WHEREAS, the Common Council finds it necessary and desirable to amend the Carmel/Clay Zoning Ordinance Z-289, as amended (the "Zoning Ordinance"), as it applies to such areas to ensure that such areas will continue to be used for low intensity residential development; NOW, THEREFORE, be it ordained by the Common Council of the City of Carmel, Indiana, that, pursuant to IC 36-7-4-600 et seq., it adopts this Ordinance as an amendment to the Zoning Ordinance and amends and restates Section 5.1 of said ordinance, entitled S-1 Residence District - Permitted Uses, to read as follows: 5.1 Permitted Uses Home occupation Kennel, residential Single-family dwelling 5.1.1 Minimum Area Requirements: Use, Location Residential subdivision, located west of Spring Mill Road and noah of 141 st Street Residential subdivision, located west of Spring Mill Road, noah of 116m Street and south of 141st Street Minimum Area (Acres) 0.77 acres, times number of lots in subdivision 1.00 acres, times number of lots in subdivision Equivalent Density (Maximum) 1.3 lots, times number of acres in subdivision 1.0 lots, times number of acres in subdivision density.doc 5/19/97 1 Residential subdivision, located west of Spring Mill Road and south of 116~ Street Residential subdivision, located east of Spring Mill Road 0.77 acres, times number of lots in subdivision 0.35 acres, times number of lots in subdivision 1.3 lots, times number of acres in subdivision 2.8 lots, times number of acres in subdivision This section does not affect the height and area requirements for individual lots which are contained in Section 5.4 of the Zoning Ordinance. day of Kevin Kirby, President, Common Council Robert Battreall Billi~ ..~alker ATTEST: Dian..a L.
