RE: Sign Permit Application
Dear Mr. Vackar:
This correspondence is in response to a personal conversation I had on January
25, 1999 with Mr. Bob Vackar who came to my office representing you. He indicated
that you are experiencing some difficulties in gaining approval of your sign permit
application filed with this Department on December 17, 1998, for your business located
at the address shown above. This further confirms information I discussed telephonically
with you on the date of this correspondence, as well as previous conversations you have
had with Mr. Mark Monroe of my staff.
Your business is located within the area known as the US 421-Michigan Road
Corridor Overlay Zone which is identified in a Zoning Ordinance Z-326. The purpose of
the ordinance is to provide for consistent and coordinated treatment of the properties
within and along the overlay zone, which extends along US 421 and 400 feet either side
of the road right-of-way as it, proceeds through the Clay Township portion of Hamilton
County. Section 23C.14.4 of that ordinance requires that "A Sign Plan for the purpose of
development shall be submitted to the (Plan) Commission for its approval as part of the
ADLS (Architecture, Design, Landscape and Signage) application. Signs for each
proposed us shall be uniform in character as to color and architectural design as approved
by the Commission."
The owner of your building, as the petitioner for this project, provided a Sign
Plan, which was approved as part of the ADLS for his overall project. At that time the
Sign Plan required tenants to have signage which was Black Lettering on White
background contained on a wall -mounted, backlit, box fixture. The Department has been
flexible in allowing a substitution of colored lettering for black lettering, however has not
changed the requirement to have a White background.

Your application for a sign permit cannot be approved as currently presented. It
does not comply with the property owner's approved Sign Plan. The only relief from this
requirement is for the property owner who may, if he chooses, replace his approved Sign
Plan with a new design. In order for him to do that he must amend the Sign Plan by
going before the Commission for ADLS review and approval. Should the owner be
reluctant to pursue this course of action, on your behalf, and you wish to gain our
approval of your sign permit application, you will have to amend your currently filed
application by substituting a new drawing which complies with the current Sign Plan.
