A RESOLUTION OF THE COMMON COUNCIL OF THE CITY
OF CARMEL, INDIANA GRANTING CONSENT TO THE
TOWN OF WESTFIELD, INDIANA FOR
ANNEXATION OF CERTAIN PROPERTY
WHEREAS, I.C. 36-4-3-9(b)(2) requires a town to obtain the consent of the
legislative body of a third class city before annexing territory within three (3) miles of the
corporate boundaries of the city; and
WHEREAS, the City of Carmel, Indiana CCarmel") is a third class city; and
WHEREAS, the Town of Westfield ("Westfield") is contemplating the annexation
of property within three (3) miles of the corporate boundaries of Carmel; and
WHEREAS, Carmel desires to grant blanket consent to Westfield for the
annexation of property noah of 146th Street and it's right of way.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Carmel, Indiana as follows:
So long as West field provides prior written notice, a legal description and a
survey or equivalent illustration of the property to be annexed into West field (the
"Documentation"), which property is then within three (3) miles of the northem corporate
boundary of Carmel, noah of 146th Street and its adjoining right of way, and so long as
Carmel does not object within fifteen (15) business days of receipt of the Documentation,
Carmel hereby grants consent for the annexation. Documentation shall be sent certified
mail, return receipt requested. Receipt of the Documentation shall mean the last date on
which such is received by the Mayor, President of the Common Council and the Clerk-
Treasurer.
This Resolution shall be effective on the date that a similar ordinance is passed by
the Town of Westfield and delivered to Carmel.
PASSED by the Common Council of the City of Carmel, Indiana this

Part of the East Half of the Southeast Quarter of Section 35, Township 19 North, Range 3
East in Washington Township, Hamilton County, Indiana, described as follows:
Beginning at the Southwest comer of the East Half of the Southeast Quarter of Section
35, Township 19 North, Range 3 East; thence North 00 degrees 47 minutes 42 seconds
East (assumed bearing) on the West line of the East Half of said southwest Quarter
1649.22 feet to a point that is 990.00 feet South of the Northwest comer of said East
Half, thence South 89 degrees 50 minutes 34 seconds East parallel with the North line of
said Southeast Quarter 93 1.91 feet to a point on the approximate centerline of the Evan
Kendall Legal Ditch, said point being 393.00 feet North 89 degrees 50 minutes 34 seconds
West of a point on the East line of said Southeast Quarter that is 990.00 feet South 00
degrees 54 minutes 13 seconds West measured on said East line from the Northeast
corner of said Southeast Quarter; thence Southerly with the meandering of the cente~ine
of said Evan Kendall Legal Ditch to a point on the South line of said Southeast Quarter
that is 508.00 feet North 89 degrees 46 minutes 53 seconds West of the Southeast comer
of said Southeast Quarter; thence North 89 degrees 46 minutes 53 seconds West on said
South line 813.77 feet to the place of beginning, containing 32.65 acres, more or less.
Subject to the Statutory Easement for the Evan Kendall Legal Drain, an open regulated
ditch along the Easterly side of the above described real estate.
Subject also to the fight-of-way for Indiana State Road No. 32 across the Southe~y side
of the above described real estate, per an Agreement made between the Board of County
Commissioners of Hamilton County, Indiana and the Indiana State Highway Commission
on September 18, 1922 and a Petition to change and establish the width of the Westfield
and Lebanon Road filed on September 5, 1922 in the Commissioners Court of Hamilton
County, Indiana.
Subject also to the fight-of-way for Dartown Road across the Westerly side of the above
described real estate.
Subject further to all other legal easements and fights-of-way.

Dear Ms. Wolf
The Westfield Town Council is contemplating annexing a certain land parcel that is
located within three miles of the corporate limits of the City of Cannel. I have attached a
map indicating the location of this parcel (Alpha Tau) in addition to the legal description
described as Attachment "A".
The owner of this parcel is requesting voluntary annexation and would like the
Council to consider it at our April 14th meeting.
In accordance with the provision of IC36-4-3-9 we are hereby requesting approval
by the Carreel City Council to allow the town of Westfield to annex this area. I would
appreciate it if this item could be added to your next council agenda.
