HomeMy WebLinkAboutCC-02-05-96-02 Monon Corridor AcquisitionRESOLUTION CC-02-05-96-02 RESOLUTION SUPPORTING LAND ACQUISITION OF THE MONON COKRIDOR WttEREAS, within the boundaries of the City of Carreel (the "City") and the Township of Clay extends a railroad corridor comprised of approximately 25 acres of real estate, commonly known as the Monon Corridor, that is no longer being used for railway purposes; and WHEREAS, the Monon Corridor has been idemi~ed as being under the control and ownership of CSX Transportation, Inc., it's parent or subsidiary(ies) (collectively "CSX"); and WHEREAS, CSX has indicated that it has no intention to restore the Monon Corridor to railway use; and WHEREAS, throughout this country, corridors such as the Monon Corridor, no longer used for or committed to railway purposes, have commonly been acquired by local governments and developed as linear parks for recreational use by the public, olden along with other compatible uses such as the extension of utility lines; and WHEREAS, the Common Council of the City of Carreel, Indiana, upon the urging of a substantial portion of it's citizens, has determined that the Monon Corridor should be acquked by the City for the publids use as a linear park and perhaps for other compatible government uses including underground utilities and fiber optic cable; and WHEREAS, Indiana Code 36-1-10.5-5 requires that the purchase of such real property by a political subdivision be preceded by the adoption of a resolution by it's fiscal body that expresses that body's interest in making that purchase. NOW THEREFORE BE IT RESOLVED by the Common Council of the City of Cannel, Indiana, that: The City of Carrnel is interested in purchasing from CSX Transportation, it's parent or subsidiary(ies), all of it's real property interests within the boundaries of the City of Carmel, Indiana, and the Township of Clay, Indiana, comprising the Monon Corridor from 96th Street to 146th Street.
