RESOLUTION OF THE COMMON COUNCIL OF CITY OF CARMEL,
INDIANA, REGARDING THE REVIEW OF THE PARK IMPACT FEE,
IMPACT ZONE AND ZONE IMPROVEMENT PLAN
WHEREAS, the Common Council of the City of Carmel (the "Common Council"), in compliance
with applicable law, adopted the Parks and Recreation Impact Fee Ordinance (the "PRIF Ordinance") on
November 4, 1996, which Ordinance is codified in the Carmel City Code at Section 10-121; and
WHEREAS, the PRIF Ordinance established a park impact fee of Eighty Four and no/100 's Dollars
($84.00), (the "Impact Fee"); and
WHEREAS, Section 10-121 (n) of the City Code provides that because the Impact Fee is based
upon information that, in large part, is subject to inflation and other economic and market forces over
which the Common Council has no control, the Common Council may, not less than once each year, cause
a review to be made by the Director of the Department of Community Services or such consultants as may
be required, to determine the continuing validity of the Impact Fee, the Impact Zone, and the Zone
Improvement Plan; and
WHEREAS, under IC 36-7-4-1340, the Impact Fee may not be collected more than five (5) years
after the effective date of the PRIF Ordinance, unless a replacement impact fee ordinance is adopted within
that period; and
WHEREAS, the Carreel/Clay Park and Recreation Board, by and through the Director of the
Carreel/Clay Park and Recreation Department, has requested that the Common Council review the Impact
Fee; and
WHEREAS, the Common Council has not caused a review to be made of the Impact Fee, the
Impact Zone and/or the Zone Improvement Plan since the inception of the PRIF Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF CITY OF
CARMEL, INDIANA, as follows:
Section 1. The Director of the Department of Community Services (the "DOCS Director"),
employing such consultants as may be required in the reasonable discretion of the DOCS Director and the
Director of the Carmel/Clay Park and Recreation Board, is hereby directed to cause a review to be made
to determine the appropriateness of the Impact Fee, the Impact Zone, and the Zone Improvement Plan and,
if deemed necessary, to prepare a proposed replacement impact fee ordinance.
Section 2. This Resolution shall be in full force and effect from and after its adoption by the
Common Council and upon compliance with the procedures required by law.
