HomeMy WebLinkAboutCC-09-18-95-03 Purchase Land/Water Well Sites 0ct-18.q -o3 A RESOLUTION AUTHORIZING THE PURCHASE OF FEE SIMPLE INTEREST IN REAL ESTATE AND INTERESTS IN EASEMENTS WHEREAS, pursuant to Indiana statute, the Carmel City Council is required to pass a resolution authorizing the acquisition of real estate and any improvements; and WHEREAS, the Carmel City Council recognizes the need to acquire additional real estate for water well sites to provide a supply of wa..ter to the Carmei Utilities water system; and WHEREAS, there exists a public purpose and necessity to acquire specific sites-of real estate to provide an ample supply of ground water for the Carmel Utilities water system; and WHEREAS, pursuant to appraisals, the Carmel City Council .now authorizes the payment of monetary amounts up to, but not exceeding the average of two appraisals for each specific site of real estate; and WHEREAS, the exact location of the legal description is based upon public necessity that a water supply exists at that location pursuant to extensive test results of water wells. WHEREAS, the legal descriptions of these sites are incorporated herein, made a part hereof and marked as Exhibit A. NOW, THEREFORE, be it resolved by the Common Council of the City. of Carmel that: Section 1. The specific site of real estate and/or easement, commonly described as legal description, incorporated herein and made a part hereof, shall be acquired for a price not to exceed $252,000 on the Tyner property and $69,560 on the Myers property. Exhibit B is incorporated herein and made a part hereof. Section 2. Be it further resolved that the Common Council of the City of Carmel, hereby authorizes all provisions to take place immediately of this resolution and any section, sentence, provision or the application thereof to any person or circumstance shall be declared invalid, such invalidity shall not affect any other parts of the resolution which can be given effect without the invalid part, and to this and the provisions of this resolution are declared to be severable.
