HomeMy WebLinkAboutBPW-09-06-95-07 Family Med LeavRE SOLUT I OB~Oq ' OC '9~"O 7 AN AMENDMENT TO FAMILY MEDICAL LEAVE POLICY WHEREAS, the City of Carmel, Indiana has enacted a Resolution, BW-8-4-93-3, which established the continuing employee benefits for health, accidental death, and disfigurement and life insurance during leaves of absence; WHEREAS, it shall be necessary to keep the policy dynamic and ensure its correctness, NOW, THEREFORE, BE IT RESOLVED BY THE CARMEL BOARD OF PUBLIC WORKS AND SAFETY, THAT: On page 5 of the policy beginning with the sentence, "For a serious health condition...", number 2 and number 3 of the listed conditions shall be reversed to read: 1) The Employee is first required to use all accrued sick time, then 2) The Employee is required to use all accrued vacation and/or compensatory time off, then 3) The Employee will receive salary continuation to the extent provided under any other catastrophic illness policy. SAFETY THIS G~h DAY , 1995. Safety orks and Leaves of Absence (Con't.) Compensation While on Leave Leave taken under the Family Medical Leave Act is unpaid. It is, however, the policy of the City to require Employees to substitute other applicable earned or accrued paid time (as set forth below) for all or part of the unpaid leave and count it against the Employee's maximum twelve (12) week leave entitlement under the FMLA. For the birth of a child, placement of a child with the Employee for adoption or foster care, or to care for the Employee'.s spouse, child or parent with a serious health condition, the following paid leave time shall be first substituted for unpaid FMLA leave: 1) 2) The Employee is first required to use all accrued sick time in accordance with the requirements of the sick time policy, then The Employee is required to use all earned vacation time. For a serious health condition which makes the Employee unable to perform the essential functions of his or her job, the following paid leave time shall be first substituted for unpaid FMLA leave: 1) 2) 3) The Employee is first required to use all accrued sick time, then The Employee is required to use all accrued vacation and/or compensatory time off, then The Employee will receive salary continuation to the extent provided under any other catastrophic illness policy. City Benefits The following benefits are not affected during an UNPAID leave: a) Employee's longevity (though unpaid while on leave) would continue to accrue showing no break in service while the Employee is on eligible leave. Longevity pay (pro-rated over the remainder of the year, based on the Employee's return date) along with the Employee's regular salary shall commence upon his/her return.
