RE: ZONING ORDINANCE VIOLATION — NO SIGN PERMIT
This letter is being provided to inform you that various sign violations have been brought
to this department's attention. Most of these violations are located at 4620 E 96`h St at
the Tom Wood Land Rover/Jaguar/Volvo building, but there are also violations at 3300 E
96t' St., and 4150 E 96th St.. All signs located in Clay Township are required to have
sign permits according to Section 25.07.07 of the Carmel/Clay Zoning Ordinance which
states the following:
Except as otherwise provided in this Ordinance, it shall be unlawful for any
person to establish any sign within the jurisdictional area of this Ordinance, or
cause the same to be done without first obtaining a sign permit for each sign form
the Administrator as required by this Ordinance.
Many of these signs were granted sign permits, but then the permits were never acquired.
Therefore these permits were never issued and the signs they are for were erected
illegally. For these signs new fees were determined and late fees were added. The total
fees owed for these signs are $1,113.14. The city did not receive a sign permit
application for the Volvo sign at 4620 E 96th St., so a permit application for this sign
must be submitted. New sign permit application fees and a late fee were added and an
estimated cost for this sign are $240.03.
The service signs on this 4620 E 961h building do not match the ALDS approval and must
be changed to match this approval, or a new ADLS Amendment must be submitted to
reflect the changes and then sign permits must be obtained for any sign larger than 3 sq.
ft.
The ground sign in front of the Tom Wood/Tom O'Brien facilities was approved, but
since this approval it has been altered. This alteration requires an ADLS Amendment,
which was never completed, and therefore a new ADLS Amendment must be filed for
this sign.
The new Tom Wood Nissan building located at 4150 E 96th St. has erected a Nissan sign
without a permit or even submitting a permit application. A sign permit application must
be submitted for this sign.
As mentioned above, the fees have been determined for the sign permits that were not
acquired by you or your sign company after they were processed. New sign permit
application fees and a $103 late fee were applied to these permits. Per the Carmel/Clay
Zoning Ordinance Section 29.06.07, after five (5) days of this notice these fees may
increase by $25.75 per day per sign as long as the violations continue. A breakdown of
the fees owed for these permits are as follows:
• Tom Wood Pre Owned at 3300 E 96' St
o $77.25 application fee + $30.90 (per sign face) + 1.65/sq ft (60.1 sq ft) +
$103 late fee = $341.22
• Jaguar at 4620 E 96th St.
o $77.25 application fee + $30.90 (per sign face) + 1.65/sq ft (18.27 sq ft) +
$103 late fee = $241.30
Tom Wood at 4620 E 96th St.
o $77.25 application fee + $30.90 (per sign face) + 1.65/sq ft (33 sq ft) +
$103 late fee = $265.60
• Land Rover at 4620 E 96th St.
o $77.25 application fee + $30.90 (per sign face) + 1.65/sq ft (32.65 sq ft) +
$103 late fee = $265.02
• Total — $1,113.14
