HomeMy WebLinkAboutBPW-07-20-94-04Earned LongevityResolution BW-7-20-94-J4 A RESOLUTION OF THE CARMEL BOARD OF PUBLIC WORKS AND SAFETY ESTABLISHING AND REINSTATING EARNED LONGEVITY FOR CITY EMPLOYEE L. DIANNE FREWER WHEREAS, on March 2, 1994, the Office of the Attorney General, State of Indiana, formally demanded repayment to the City of Cannel, Indiana, a sum of $726.92 from City employee, L. Dianne Frewer for monies overpaid by the City of Cannel to said employee for earned longevity; and WHEREAS, the Office of the Attorney General, State of Indiana, urged said employee to pay the funds or file a formal dispute with the Office of the Attorney General; and WHEREAS, City of Cannel employee, L. Dianne Frewer so filed a petition to the Indiana Attorney General disputing said charge and disputing removal of one year of earned longevity from her salary; and WHEREAS, after review of all documents pertaining to the disputed charge, on March 31, 1994 the Office of the Attorney General of the State of Indiana wrote a decision as follows: "...Because of the ambiguity of your hire date and the varying interpretation of the ordinance I have recommended to the State Board of Accounts that this matter not be pursued. The State Board of Accounts has agreed with our decision to not continue pursuit of this matter."; and WHEREAS, the Cannel Board of Public Works and Safety agrees that ambiguity exists and deems it necessary to exempt the employee from liability and to reestablish longevity as originally computed by the City due to the findings of the Attorney General's Office of the State of Indiana and agreement of the State Board of Accounts to not pursue the matter. NOW, THEREFORE, BE IT RESOLVED by the Cannel Board of Public Works and Safety that effective immediately, establishment of earned longevity for City of Cannel employee L. Dianne Frewer shall be the earned longevity as prescribed by the City in 1986, to be based upon a first year earned longevity date effective January 1, 1987. Be it further resolved that the Board respectfully requests all monies withheld from L. Dianne Frewer as a result of reducing her hi-weekly salary by removal of one (1) year earned longevity, since November 1992, be reimbursed to her, in full, by the Clerk- Treasurer of the City of Carmel as expeditiously as possible.
