HomeMy WebLinkAboutCC-05-15-00-02 Parson BrinkerhfRESOLUTION NO. 05-15-00-02 WHEREAS, the Cannel Clay Plan Commission, at the request of the US 31 Corridor Task Force, has retained the consulting finn of Parsons Brinkerhoff to study and provide recommendations related to the State of Indiana Department of Transportation (INDO1D proposed plans for a US Highway 31 Freeway Upgrade, and its impact on the City of Cannel and Clay Township, and WHEREAS, Parsons Brinkerhoff has determined that segments of the INDOT plans would have a detrimental impact on the adopted Carreel/Clay Thoroughfare Plan, especially as they pertain to a conflict between an INDOT proposed interchange at 136th Street and our proposed extension of Illinois Street, and WHEREAS, pursuant to Indiana Code Section 36-74-506, after a thoroughfare plan has been included in the Comprehensive Plan for a community, thorouglffares may be located, changed, widened, straightened or vacated only in the manner indicated by the Comprehensive Plan, and WHEREAS, Parsons Brinkerhoff has developed an alternative to the INDOT proposal which would phce an interchange in the area of 13 1~t Street, as well as provide for the extensions of Illinois Street (a.k.a. Meridian Comers' Boulevard ) and Pennsylvania Street to intersect at a common location in the US 31 Corridor, and WHEREAS, pursuant to Indiana Code Section 36-7-4-504, INDOT is required to give due consideration to the policy set out in the Comprehensive Plan, in regard to the authorization, construction, alteration, or abandonment of the public ways, and WHEREAS, the 1970 Federal Highway Act, places a responsibility on the Federal Highway Administration to fully consider adverse effects of transportation on community cohesion, public facilities, employment, tax and property values and community and regional growth, and WHEREAS, the Parsons Brinkerhoff interchange proposal has been recommended to the State of Indiana DOT by the Mayor of Carreel in a letter to Steve Cecil, Deputy Commissioner, dated March 1, 2000, and requested for serious consideration by INDOT in lieu of any other plan for the same area on U.S. 31, and WHEREAS, future land development within the four quadrants abutting the area of 13 1 ,t Street and US 31 and located in the U.S. 31 Overlay Zone, threatens the possibility of the Parsons Brinkerhoff interchange recommendation from being a viable consideration by INDOT during their Environmental Impact Statement process, which could last more than two years, and WHEREAS, the US 31 Corridor Task Force, at their public meeting on May 4, 2000 voted unanimously to recommend the Cannel City Council adopt a resolution making the Parson's Brinkerhoff interchange proposal the preferred solution for future US 31 Freeway Upgrade to best meet the Cannel/Clay Township Thoroughfare Plan, which should then be communicated to the State of Indiana, and WHEREAS, the US 31 Corridor Task Force, at their public meeting on May 4, 2000, voted unanimously to recommend the Cannel City Council adopt a resolution setting a lime frame of 90 days to allow the State of Indiana and the City of Cannel and oppommity to work out details which would allow the possible implementation of the Parsons Brinkerhoff interchange proposal in conformance with the Cannel/Clay Thoroughfare Plan. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Cannel, Indiana as follows; Future development plans will be held and actions tabled on any proposal for land development on parcels in the four quadrants in the U.S. Highway 31 Overlay Zone, and directly abutting the intersection of 13 1''t Street and U.S. Highway 31 for a period not more than ninety 90 days to allow the City of Cannel, namely, the Office of the Mayor, to work out the details with the Indiana Department of Transportation to give consideration and allow possible future implementation of the Parsons Brinkerhoff interchange proposal, attached hereto as Exhibit 'A'.
