DEPARTMENT REPORT
MONDAY, AUGUST 23, 2021
(V) Bacon Garage Size Variance.
The applicant seeks the following development standards variance approval:
7. Docket No. PZ-2021-00143 V UDO Section 5.02.B.3 Maximum 24’ x 30’ detached
garage allowed, 24’ x 36’ requested (and total garage areas exceeding 75% of the ground floor area
of the principal building). The site is located at 9637 Maple Drive (Forest Glen Subdivision Lot 33). It
is zoned S2/Residence. Filed by Scott & Dawn Bacon, owners.
General Info & Analysis:
The Petitioner seeks approval for a detached garage in the back yard that is larger than what is allowed. Please
see the Petitioner’s info packet for more detail on the variance request.
Per the UDO, a maximum allowed detached garage can be 24’ x 30’ in size (720 sq ft). The Petitioner proposes
a detached garage that is 24’ x 36’ in size (1,224 sq ft).
UDO section 5.02.B.3 states the following about Maximum Ground Floor Area for an Accessory Building:
a. The combined square footage of the Ground Floor Area of a Private Garage and/or Accessory Building
shall not exceed seventy-five percent (75%) of the Ground Floor Area of the Principal Building.
b. A detached garage, which is the only Accessory Building on the lot, may equal the maximum dimensions
of twenty-four (24) by thirty (30) feet provided that the Ground Floor Area of the garage is less than or equal
to the Ground Floor Area of the Principal Building.
The current attached garage is 24' x 20'. The main floor area of the first floor of the house is 24' x 48'. The
existing attached garage will eventually be renovated and turned into livable space, sometime next year. After
the attached garage is converted into living space, this will allow for the main floor of the home to become 24' x
68' of living space. Then, only the detached garage will exist as an accessory use/structure.
The Petitioner addressed all planning/zoning review comments; the Planning Dept. supports the variance
request.

Recommendation:
The Dept. of Community Services (DOCS) recommends positive consideration of PZ-2021-00143 V, with the
adoption of the findings of fact submitted by the Petitioner.
