HomeMy WebLinkAboutBPW-09-16-91-01Water HookupA O RESOLUTION ~'/~/' ~ RES LUTION PERMITTING WATE~OOKUP IN ROLLING ACRES AND ROLLING MEADOWS SUBDIVISIONS TO THE CITY OF CARMEL WHEREAS, the City of Carmel is providing water utility services to Rolling Acres and Rolling Meadows Subdivisions;and, WHEREAS, it is in the best interest of the citizens of those subdivisions that they be allowed to pay the hook-up charges for that service on a regularly scheduled basis;and, WHEREAS, action by the Carmel Board of Public Works and Safety is required to permit hook-up payments on an installment basis; NOW, THEREFORE, BE IT RESOLVED BY THE CARMEL BOARD OF PUBLIC WORKS AND SAFETY,that: 1. All affected residences and/or businesses shall be given immediate written notice by the City Engineer's Office, that they may conn ct to the utility system, within ninety (90) days of th~ rouolution.~~'~- 2. The utility availability fee will be calculated per Carmel City Ordinance A-54, as amended. The maximum area that an owner of affected property shall be charged will be up to one (1) acre upon which the business or residence is located, provided the property owner shall provide the City Engineer a legal description of the affected property. This provision does not nor intended to operate a forgiveness of availability or other fees for future connections for the property should other structures be added or the property subdivided. 3. At the time the connection is applied for by the property owner, all applicable fees and charges shall be paid, however the owner may request, as an alternative to immediate payment, that the City accept an installment payment agreement as follows: Combined Availability and Connection Fees in Dollars Number of Equal Monthly Payments $1.00 to $1,500.00 $1,501.00 to $3,000.00 over $3,000.00 6 12 18 No interest charges shall be assessed against the owner, unless default in any payment or otherwise breaches this agreement or the installment agreement. In the event of Default, the property owner shall be responsible for interest on the unpaid balance at a rate of twelve percent per annum (12%), together with all reasonable costs of collection, including reasonable attorney's fees. 4. Payments may be mailed to the City Engineer's Office at One'Civic Square, Carmel, Indiana 46032, and will be applied first to availability fees and then to connection fees. Billings for the charges and fees shall be commenced immediately, unless otherwise agreed as provided herein. 5. The City Engineer is instructed to include in the Ninety (90) day notice to property owners that billings for the service provided will originate from the Office of the Utilities Manager, which billings are separate and apart from those charges and fees for availability and connection. 6. The City Engineer or his designee is hereby authorized to enter into the appropriate payment agreement\ installment contract, prepared by the City Attorney, with the property owner, in conformance with this resolution.
