BOARD OF PUBLIC WORKS & SAFETY
A RESOLUTION ESTABLISHING THE POSITION OF BAILIFF
AND DEPUTY BAILIFF WITHIN THE
CARMEL METROPOLITAN POLICE DEPARTMENT
WHEREAS, the Indiana Code at I.C. 33-10.1-6-3 provides that
the Carmel City Court Bailiff must be a member of the Carmel
Metropolitan Police Department, unless otherwise appointed by the
Carmel City Judge; and
WHEREAS, a need exists for a bailiff and deputy bailiff in
the Carmel City Court; and
WHEREAS, there does not exist a job category for the
position of bailiff or deputy bailiff within the Carmel
Metropolitan Police Department, in either the reserve or regular
officer ranks;
NOW, THEREFORE, BE IT RESOLVED by the Carmel Board of Public
Works and Safety as follows:
1. There is hereby established the job descriptions of
bailiff and deputy bailiff within the Carmel Metropolitan Police
Department in both reserve and regular police officer ranks.
2. It is further established as an exception to the rule
prohibiting monetary payments to a reserve officer for services
rendered, that if the reserve officer is acting as the official
bailiff or deputy bailiff, or has been appointedby the Judge of
the Camel City Court, he may receive such compensation as is
provided by the budget of that court for those services rendered.
3. No regular officer of the Carmel Metropolitan Police
Department may serve as bailiff during his regularly scheduled
shift or duty time. A regular officer shall be entitled to
receive such compensation as is provided in the budget of the
Carmel City Court only if that regular officer performs his
duties as bailiff or deputy bailiff while off duty.
4. No reserve officer may serve as a bailiff or deputy
bailiff unless he/she has been Indiana Law Enforcement Academy
qualified.
5. No reserve officer may serve in the position of bailiff
or deputy bailiff if that reserve officer:
(a) is also on duty~ at the time of service, with any
other department of the City of Carmel, or any other law
enforcement agency;
(b) is wearing the uniform of any ~uw enforcement
agency, other than the Carmel Metropolitan Police Department
Reserve, or is using the equipment, weapons, or supplies of any
law enforcement agency, other than the Carmel Metropolitan Police
Department;
(c) presents himself/herself, uses the authority of,
or attempts to exercise the police powers of any other police or
law enforcement agency other than those powers granted him/her by
virtue of their position as a Carmel Reserve Police Officer.
6. In addition to the above restrictions, the bailiff or
deputy bailiff, while serving as bailiff, shall obey all other
rules of procedure of the Carmel Metropolitan Police Department
not in conflict with this resolution.
