HomeMy WebLinkAboutBPW-06-07-00-04 Wireless TowersResolution BPW-06-07-00-04 A RESOLUTION OF THE CARMEL BOARD OF PUBLIC WORKS AND SAFETY TO ESTABLISH CITY POLICY REGARDING THE USE OF CITY PROPERTY FOR WIRELESS TELECOMMUNICATIONS FACILITIES WHEREAS, pursuant to IC 36-9-6-3 and the Carmel City Code, the Cannel Board of Public Works and Safety has custody of all real and personal property of the City and is responsible for the maintenance thereof; and WHEREAS, various wireless telecommuff~cations companies and agents therefor have expressed interest in leasing real property of the City for the purpose of erecting new towers or other structures to house wireless telecommunications antennas and other equipment; and WHEREAS, pursuant to Carmel City Code §10-93(g)(5), all City of Carmel and Clay Township governmental facilities and buildings are exempt from the zoning requirements and procedures listed in the Cannel Clay Zoning Ordinance, but such exemption does not extend to structures owned by private parties which may be sited on real property of the City; and WHEREAS, the Board of Public Works and Safety now finds it necessary and desirable to set forth the policy of the City regarding the use of City real property for the purpose of accommodating wireless telecommunications equipment owned or operated by private parties. NOW, THEREFORE, BE IT RESOLVED by the City of Carreel Board of Public Works and Safety as follows: The City hereby encourages private parties that need to locate new wireless telecommunications facilities in this community to collocate their equipment on existing towers, buildings, or structures, in accordance with the Cannel Clay Zoning Ordinance. The City will duly consider proposals to construct new facilities, or to collocate on existing facilities, on any real property of the City which is now located in the Industrial zoning districts under the Carreel Clay Zoning Ordinance or which may hereafter be rezoned to an Industrial classification, provided that such collocation and/or new facilities will not harm property values in any areas that abut or are immediately adjacent to said Industrial zoned districts. However, the City hereby discourages proposals lbr the construction of new towers and/or other similar facilities on any real property located in the City which is located in any of the zoning districts other than Industrial found in its Zoning Ordinance, or which is located in an Industrial zoned district located near other zoned districts in cases where such a location would have an adverse impact on the values of real property located immediately adjacent to or that abuts the Industrial zoned district. Page One of Two Pages The City will duly consider proposals to collocate wireless telecommunications equipment on existing towers or other structures on any real property of the City which is located in any zoning district. However, such proposals must give due regard to the City's primary use of such towers or other structures for public health, safety and welfare purposes, and where required by the Zoning Ordinance, must also be submitted to the Cannel Clay Board of Zoning Appeals for special use approval. 4. The City Department of Administration is hereby designated as the City's agent with respect to the negotiation of any agreements for the use of City properties for wireless telecommunications facilities. However, all such agreements must be substantially in the forms developed by the City of Cannel Department of Law for such purposes. Approved and Adopted this '77~ day of/[ l/ZZ , ,2000.
